Don't they always send out that letter with details over the side about how to pay the fine to avoid prosecution? I thought the penalty was about £60 and 3 points. They would most probably rather take your money than take you to court are you sure there are no more details there?

Hi, my dad was caught going at 120mph on the motorway and he only got a 3 month ban so it can't be worse than that, can it?
I know that's not great, especially when you have children but it's not the end of the world.

Is there really no points and fine alternative? I guess there must be a certain amount over that you can go at which point this kicks in instead.

I'm guessing you'll be offered the chance to pay for a driving course instead of a fine, but may get points as well.

If you need more concrete ideas, might be worth posting in the legal section and mentioning what it's about in the title.

Flossam- I think you get more than a fine if you are going a lot faster than the speed limit but I don't know for sure.

Try not to panic. I'm sure it won't be too bad.

dh got one the other month, he is disputing this as they claim he went through a red light at 30mph, but he was towing a machine slowly

I had a letter of 'intended prosecution' for going through a red light , BUT when I had calmed down, I realised it said I could send my licence and a fine and they would consider...blah blah.

Is there no option for that? Read all the way through the letter very carefully!

(though I think you are a lawyer, so may be teaching you to suck eggs - sorry!)

So it doesn't say send your licence, or any money? Does it ask you to confirm that it was you driving?

The minimum penalty is a fine of £60 plus 3 penalty points. If your speed was above a certain limit then you can be prosecuted in court and in that case there may be a higher fine and the possibility of a ban.
From memory, I think you would have to be at least 20mph over the limit for this to happen, so I think you should be okay (I'm sure someone will know for certain). I would also let the courts know of your mitigating circumstances, ie your sick dd. It probably won't make any difference but it's worth a try.

I have had a notice of intended prosecution, it is a standard letter for 3 points and a fine, double check it and there should be a phone number to call to pay or an address to send your stuff to for you licence to be endorsed.

They just make it look scary because they are bastards.

If you look at this page (scroll down a bit), it looks like you get a summons (as opposed to a fixed penalty)if you're doing over 50 in a 30 limit, not a 40 limit.But it also says further down "Police do have the power to issue a fixed penalty of £ 60 plus 3 penalty points on the spot, but not when it comes to GATSO cameras. For those cases, they must go to court."

This happened to me last August - 53 in a 40. You fill in the form to admit it was you, then they send you a further form with your fixed penalty which will be £60 and you send them your licence which they put three points on. You don't get banned unless it's a huge speeding offence or you already have 9 points on your licence. Don't worry - I now drive everywhere at exactly the limit and annoy all the drivers sitting on my bumper. Most insurance companies don't up your premium for a first speeding offence, but you do need to tell them once you have been fined.

my dad did get a ban but i think no points or fine- weird. But he was going over 50mph OVER the limit- what an idiot. And he was stopped by a police car rather than being caught on camera- think that might make a difference.

this website says that you will only get a ban if you were more than 26mph above the speed limit, where the limit was over 30mph provided you currently have no more than 8 points on your licence.
So you should be okay.

Says in Dp's sargeant exam book that it is standard to send out fixed penalty notices when flashed by a speed camera. I'm almost certain you won't be going to court for this. is there a number you could ring in the morning?

Send the form back with the relevant details.

In the meantime, renew your driving licence. If you receive a conditional offer (fine/points) and you've not got your licence back, ring the relevant dept, they will usually delay proceedings for a couple of weeks.
