Dear Ms Clark,
Thank you for your correspondence about our recent visit. As we discussed the visit was made following the receipt of complaints against your agency.
During the visit we discussed The Conduct of Employment Agencies and Employment Businesses Regulations 2003 and we outlined the breaches we found under those regulations.
The breaches in regulation we found under regulations 16 and 17 required that you make some minor changes to the wording of your terms with workers and your terms with hirers, you have already made these changes and your terms now comply with the legislation.
On the matter of exchange of information between workers and hirers under regulation 21 and the recording of that information we discussed the information you need to keep when workers were actually supplied to hirers. In the majority of cases you already had this information but have confirmed that you now have systems in place to provide workers and clients with the required information and to keep records of the information you have provided in all cases.
Although we could not discuss the complaints specifically as the complainants did not wish their identities to be disclosed. The nature of the complaints fell into 2 categories concerning:
a)the amount Bizzykidz charges, and
b)the inability of the agency to produce lists of jobs specific children had been submitted to.
We looked closely at the agency charges and decided that for the services provided the charges were reasonable and therefore comply with the legislation. Secondly as we discussed although you are required to keep specific records for children who have actually secured work there is no legislative requirement for you to record every job you submit a child to.
I hope this clarifies matters for you.
