If you are funded for up to 15 hours for an under 2 can the nursery say you can only have 10 hours and not the 5? So a full day at nursery and then not a half day to use the other 5 hours.

At my nursery, I wasn't allowed to choose my own hours to send him if that's what you mean? I was given three options of time lengths, so 3 hours five days, 5 hours three days or 7.5 hours 2 days, to make up the 15 hours. They are paid for 15 hours by the funding scheme so they can't tell you you can only take 10 - if this is what you mean? If they are I'd find a different nursery if possibly, they sound difficult.

They are upping fees from September and within the letter it takes about the funded hours. If says the 3 year old funded hour children have to pay a consumable charge. And the 15 hour 2 year olds can have a full day free. However a full day of their opening hours amounts to 10 hours which my DS does. So they wouldn't be using the whole 15 hours. He would be going for 3 days all together so those extra 5 hours they are taking away would cost me alot extra!
It's a great nursery and he has a good allergy which they are good with. I don't really want to change nurseries. Just wondered if they were allowed to do this

Are they open all year round?
A full day all year round does equal 20 hours a week and not 15
It's only 15 if they are only open for 38 weeks of the year
And yes, the nursery are allowed to offer the funded hours any way they choose

Our nursery lets us use them however. But we do pay extra to tip up as we need him in nursery 20hrs a week all year, so not just term time.
We get the funding as my son is adopted.

They are open 51 weeks. I thought they only would take away the hours per week for the 34 weeks they could have them? So 10 hours (a full days charge, which they are saying he can have and not 15 hrs.) times 34. Take that away from the average yearly figure then divide by 12?

How have you got funding for an under2? I have an 19 month old and live in Scotland and we won't get nursery/preschool funding until January 2020.

You are getting the 15 hours just stretched over 51 weeks.
34×15 = 510

Under 2s get funding if parents under a certain income or on certain benefits, in Scotland anyway.

He will be 2 this morning and the funding will start in September when he will be there 1 extra day due to me studying
Yes I do get the funding.
Just checked the government website saying you can have 570 hours per week. If the nursery says I can only have 10 then that's 60 hours in not getting!! Surely that's not allowed??

And yes it sounds like they're spreading the hours out. It's only 15hrs per week if it's term time only

It's not under 2s, it's 2 year old funding. Lots of people where I used to work called it under 2s as well but it's for children who are 2, not younger.

When my DD was younger her nursery offered 15 hours term time only or 11 hours every week.

To be honest OP, whatever they technically can or can't do is irrelevant in the real world. The reality is that you can accept what they offer or find another nursery, because the alternative will cause an an irreparable breakdown in any relationship between you and them.
It might not be fair, it might not be right, but that's the way it is.

And can I also say you are lucky to get it. I have had to pay and my fees subsidise those funded. I would love to go and study or have a free day but I have to work

Yea I am lucky but I'm going to go back to study as I'm on a low wage and want to better myself. So not really my fault I'm in this position that I can get the funding. It's the government's rules not mine

No you don't have to use all the hours but the nursery may only offer a place if you do
