Landlord says he's starting legal proceedings TODAY.....How much time have we got??

He is adamant that we are behind in rent (which we are now, but not as much as he says) We have another house to go to but can't go for about another 10 days or so....

Once he has started proceedings how quickly can he throw us out??

Here's the email from the env. health guy....

I have just received a fax from Paul Tory at Strutt and Parker.

He has sent me a signed witness statement from a service officer stating that a notice to quit was served at 16:00 on the 15th January 2005. The letter was posted through your letter-box and marked for the attention of Martin Myers.

From a legal point of view this notice would seem to have been properly served and as such you should have quit the property on the 8/4/05.

Since the due process has been followed and my inspection of your property did not reveal any unfitness I do not think this Department has any reason for further involvement.

If you have any further queries please do not hesitate to contact me.

Makes me laugh - if we should have been out on 8/4/05 why was he sending me letters saying to go by the 31st May?? Surely the fact that he's left it this long says something's a bit dodgy. Oh well - hopefully this house will be definate definate this time and then i won't have to care about the muppet of an EA any more!! (still will go to CAB though - he doesn't get off that easily!!)

I will check this if I get a chance tomorrow but I still don't think he can just serve an NTQ. I think he has to issue a Notice of Seeking Possession first & then you get a court summons for the possession hearing and then you get the NTQ.
I could be wrong though so you're doing the right thing to check it with CAB.

Like you say though, hopefully you can forget about him when the move comes through

Dunno if this is th same or not, but when we were behind with our rent we were served with a notice seeking posession. It's a h/a not private rental but i would think the same rules apply.

From what i can remember they have to serve that first.
