DLA rejected

Hi, submitted a claim early November and middle of December I received a letter saying we were not entitled to DLA but if we do not agreed with this to either ring to write to them. I wrote them a letter just before christmas asking how we proceed with appeal and to send the relevant forms. I have heard nothing yet, does it normally take this long? TIA x

I sent a letter for a mandatory reconsideration on 14th December and am yet to hear anything so in the same boat. No advice, I'm just waiting (indefinitely).

Is this for PIP? Or child DLA?

Did you actually log an MR ( mandatory reconsideration). This needs to be done within a month of receiving the decision letter assuming it's the same as PIP. I think I would call them to check this is definitely logged ? I don't think there is a specific form that you write an MR on although places like citizens advice often have a template.

When you were turned down you should have asked for a statement of reasons, this will say why they have turned your child down. Once you have the statement of reasons you do a mandatory reconsideration (MR) writing why you disagree and referencing your evidence (you can add more evidence). This is then looked at by another decision maker. Wait time at the moment is around 6 months or more. If the answer is still No then next stage is tribunal which is also another long wait.

You need to contact them and check that they have received your letter and that it counts as you asking them for a mandatory reconsideration !

If you have contacted them and said you want to go ahead with a mandatory reconsideration they will take that as being your request to do it. I would call them and ask if you can submit your evidence still. If you can make sure to challenge every part you disagree with, explain why and back it up with firm evidence.

The title says DLA and the OP says DLA. So it’s DLA.

Yeah because nobody ever mixes those up, do they? Nobody ever refers to PIP as DLA, because that’s what it was previously called.

I’m in a position to give significant insight into one of the benefits, but not the other. It’s clearly worth me asking, before giving that insight, so that I can answer her query right away.

You came along on a thread where someone is asking for advice about DLA and presumed them stupid and that they possibly actually meant PIP.

Yeah that’s what I done. I immediately thought the OP is too thick to understand the DLA/PIP difference and thought I’d jump in and make an arse of her. You got me. 😅

Do you have any clue how often people mix them up? I literally hear it every day. As I said earlier, I have insight that other posters don’t have when it comes to one of those benefits and would’ve obviously given her the detail if it applied to her. That’s all.

Anybody whose done few shifts providing welfare rights advice will know people mix them up. If it's not crystal clear client is talking about a minor then you might just want to ask a question to confirm whether it's DLA/PIP/AA.

so i sent a letter straight away after i got the letter to say tis declined, so that was mid of December, then sent the same letter again last week. Recon i still need to ring?
on the mandatory reconsideration what else do they need? thanks

"I am requesting a mandatory reconsideration." Then I bullet pointed the reasons (which referred to the reasons they gave for refusing) and noted which medical report supported my reason.

They will have taken your communication to be your request for the MR. I strongly recommend calling and asking if you can still submit evidence towards it. You need to counter every point thy have made that you don’t agree with and provide the evidence towards show why they are incorrect. If you don’t it is very likely to come back with the same result as your initial application. Definitely phone asap them to say you want to submit evidence though, as telling them you want to make the MR starts the process of the MR and it’s time sensitive.

Hi does anyone know how long people are waiting for dwp to respond to tribunal, been 3&half months no response, tribunal has send warning letter to dwp given them 28 more days to send there bundle

A friend lodged tribunal application in early February 2025 and has her child's tribunal next month, so 13 months.

So long, still waiting for response from dwp with bundle, do u know how long u have to wait for that, 3&half months wait so far

Renewal of DLA rejected.

My daughter's DLA renewal has been declined.
She is 10, and has a diagnosis of autism,OCD and severe social anxiety. She was put on meds ( fluoxitine and melatonin) at the age of 6. She has not ever slept a night through and is constantly in need of me providing reassurance and regulation throughout the day and night. She also has food avoidance and will control her food intake, so much so that she can go days without eating especially if shes anxious. Which of course she is almost everyday.
Her first DLA claim was in 2022 and at that time she was in school, however I pulled her out 2 years ago to home educate as her anxiety was getting out of control and the school were literally failing her. I would take her in earlier than the other pupils screaming, and by 10 the school would call me to collect her as they could not calm her down.
When I pulled her out she could not even read and struggled with all work.
Now here we are 2 years on, I did the renewal, stated her needs have not changed, gave them her camhs assessment dated 2024, her medications, diary's of night and day time care. A re referral to CAMHS and her doctors summary. I've explained in detail everything!
The decision maker called me a few weeks ago and asked why I have no up to date evidence other than her diagnosis from CAMHS from 2024. She asked why I have no school reports and I explained she was home educated. Her attitude on the phone completely changed. She was rude and abrupt and basically demanded I send over more newer evidence.
I explained that her diagnosis is lifelong, her needs have not changed, in fact they are probably worse now she's 10.
Anyway I had the letter today to say it's been rejected.
I'll of course do a MR, but I'm actually fuming. I feel like her being home educated has changed their view. I don't need an ehcp as a home educator, I don't see the school nurse, ep or anything like that. It's just my words and her 'out of date diagnosis'. Has anyone else experienced this at all?

I would imagine its the lsck of professionsl evidence theres no way around that

Who has been managing the prescribing of her medications? Mine is on the same meds and so we get regular letters from the reviews with specialists, if they don’t send letters following reviews I would definitely chase them for this. Unfortunately it is common that they want more up to date professional evidence as needs can fluctuate so greatly
