Hi all just a quick one, I’m on a joint claim with my partner with 2 children on the claim, iv been getting benefit capped for the past 2 years because I receive child benefit for 2 children . Last year I spoke to a case manager and she said its right been capped which I didn’t mind. But iv recently been capped more the past few months so I messaged on my journal and asked why she said it’s because I have 4 children on my child benefit claim which I don’t I only have 2 children. Iv double checked my HMRC app and only states 2 children so this must be a mistake from universal credits end. They have forwarded it to the relevant team. Does Anyone know what happens next or how long it will take to be sorted out thanks

Do either of you work? The only way to lift it is to earn a certain amount each month.

Edited to add it does sound like someone might be using your details or it be a mix up.

@itsmee12 not 100% sure I understand the question.

Are you talking about the benefit cap which, with some exceptions for health/caring, limits the overall amount the Welfare system will pay if you're not working or the two child limit?

Media reports often conflate terminology by referring to a two child cap which causes confusion.

Sorry. I have 2 children. I claim child benefit for 2 children but uc have capped me for 4 children. Sorry it’s hard to explain x

So they have mistakenly said you have 4 children but are also sorting it out?

I can’t imagine it would make any difference payment wise as you have 2 children and have been paid for 2 children. The cap thing is for further children that you don’t even have?

Yeah that’s correct on my claim it says I have 2 children but on my journal she messaged and said I’m been capped for 4 children. She said it’s because I claim child benefit for 4 children but I only have 2 and claim for 2.

it’s capped at 2 unless think born before 2017?

but if you only have 2. And he has none /dad of your 2 - then surely you are getting the right payment

what is the £1835 put down as

Child Benefit counts towards the Benefit Cap so if when calculating your benefit income UC have added in Child Benefit for two additional children then you have probably have been paid too little UC.

It shouldn’t need adjusted. If you have 2 children and are being paid for 2 children it would be correct.

There is 4 children living in the property. You have two or partner has two.

They have also only paid you for 2 children, which is the most important factor.

Now clear that we're talking about the Benefit Cap and not the two child rule.

The maximum amount you can receive from benefits, outside of London is £1835/month. Child Benefit counts towards the cap.

If you live together as a couple Universal Credit has to be a joint claim. If you and your partner have 4 kids - 2 each - on a claim then Child Benefit for 4 kids counts towards the cap

If there are only 2 kids in your household UC has got it wrong but if there are 4 it's correct.

Reads like your partner is also receiving child benefit for two children the same as you are.

Have you asked your DP?

If the total number of children in your house is 2 then you have been underpaid universal credit.

Check that you have only been paid child benefit for the two children you have and the payment hasn’t been duplicated once to you and once to your children partner.
