PIP mandatory reconsideration

mumsofdragons · 05/10/2023 12:15

Hi,

Just received a call from PIP today as I sent off my mandatory reconsideration on Tuesday (they received it on Wednesday).

The decision maker called to discuss my MR and that she will process it for me - is this normal as I'm really anxious. Why would she call just say she processed it?

Any guidance or help is appreciated

I sent off for mandatory reconsideration for the pip after I was refused due to the assessor saying the complete opposite of what I said they gave me text message saying a date they will of reviewed my case for but its that date amd I still haven't heard anything does anyone know why this could be please

It will more than likely be a no. I’ve filed for appeal as advised by support worker, my condition has worsened, I’m being referred for treatment that will mean daily hospital visits for 6 weeks and reserved for extreme cases as it’s so expensive.

I now have so much evidence and community law very confident appeal would be successful. Hoping dwp comes to their senses rather than drag it out and waste more tax payers money.

I’m awaiting dwp response to my appeal for which the deadline was the 15th.

If your condition has worsened, they may ask you to submit a change in needs / circumstances. This is because it has to relate to your condition and how it affected you at the date of the original claim.

I was unsuccessful at Mandatory Reconsideration, unsuccessful at Tribunal, but awarded enhanced at both rates on Change in needs. (I'm also having expensive treatment which is only funded for severe cases of one of my medical conditions)

This is a diagram showing the numbers of applications that are successful at each stage:

Thanks.

still no decision from dwp despite deadline passed. They have contacted my support worker and asked for a copy of my latest consultant report. Weirdly no contact to me. She has posted it to them so not expecting anything speedy to happen.

swallowedAfly · 06/04/2024 14:30

Tribunal people have written to me and enclosed a copy of the warning letter they’ve sent to dwp/pip for not meeting deadline and reminding them of legal powers etc. They’ve extended deadline by a short amount of time like 2 weeks I think which must be about to end.

It is all such a mess. They can’t strengthen their hand at tribunals if they won’t even abide by their rules and procedures.

swallowedAfly · 09/05/2024 12:05

So - KEEP GOING! Decision has changed from zero DLA to higher rate for me. They are definitely deliberately saying no to people they know will be awarded when it comes to appeal. They stalled and got extensions about three times to respond to the appeal court but eventually rather than go to appeal changed their decision.

@mumsofdragons did u get it? I scored 6 points then put through for MR. She said that she had to add a few questions and i only needed a couple of points. Which she will be doing today? She then asked if my bank details were the same. And she said ill get a letter in the next 5-10 days x

swallowedAfly · 14/05/2024 20:58

That's good news Starrrz. I'm so relieved it's sorted now. Just received my backdated HR daily living from start of July last year. Very glad I didn't get put off and kept going.

Starrrz · 14/05/2024 21:57

@swallowedAfly thats amazing! In glad you did :)
im hoping i definitely have got it! The wait for the letter is gonna be a longg wait xx

swallowedAfly · 15/05/2024 10:29

If they asked for your bank details I think you'll be getting it. Which components have you applied for?

Starrrz · 15/05/2024 11:13

Yea thats what i thought! I think ill be getting standard for daily living :) . Have u applied ? X

swallowedAfly · 15/05/2024 12:11

They awarded me lower mobility rate and nothing for living. They actually managed to give me zero points for daily living.

I now keep the mobility rate and have been awarded the higher level of daily living - I have the revised points allocation and they've given exactly the points I knew I was entitled to even though some on this thread were saying that doesn't count and you don't get points for this etc.

I was turned down at mandatory review so applied to appeal. DWP kept missing the tribunal courts deadlines for them deciding whether to change their award or let it go onto appeal and then randomly out of the blue I got a phone call offering higher rate and I accepted. Whole thing has taken over 8 months. Obviously tons of people give up. I was broken after the phone assessment that went on for nearly 3 hours and the fictitious report that followed it even though it was recorded and the recording blatantly showed how inaccurate the report was.

Anyway! Very glad it's over. Good luck for your letter coming quickly. You can't really rest till you see things in black and white ime.

This happened to me too! Also, another review, they 'lost' the successful appeal paperwork, and I had to send mine in to the DWP. Hmm.

Honestly this process almost makes you believe in evil @Orangesandlemons77

Yes. You have to (or whoever is supporting you) be 'on the ball' which of course would be most difficult for vulnerable people as well which is a worry.

swallowedAfly · 22/05/2024 20:20

Yes. You can’t afford to be naive or have any trust or expectation of honesty or decency or compassion.

Incredible just how many times they can claim to have lost or not received stuff during one claim process. My support worker was helping at one stage and she had to send something 3 times because they kept denying receiving it.

it took me weeks and a real battle to get access to the recordings of my assessment. They deliberately try to make every stage as difficult as possible and exhaust people in the hopes they’ll give up.

when you’ve been through it you know it has to be deliberate.

Orangesandlemons77 · 23/05/2024 09:49

The MP can be useful with these kinds of things. They have people in the office who can deal with them. They helped with the lost appeals notice situation and also another time when they were trying to get me to go to a nearby city for a 'F2F' on a busy Saturday and I needed a home visit due to severe MH issues.

Orangesandlemons77 · 23/05/2024 09:50

Also sending things recorded / special delivery which is more expensive of course :-(

swallowedAfly · 31/05/2024 09:57

They even ignored special delivery items. It proves you sent it but doesn't prove they received it as it is delivered to a huge building rather than a department and they seem to be good at losing things in their internal post management.

My support worker sent my psych reports recorded delivery after they
'didn't receive it' the first time. In the end she got it agreed that she would talk to the person reviewing my case would call her and she would email it to them live and they could confirm receipt. Madness.

I've just had the text about a review after 5 years, been on it since 2014 and gone to appeal twice :-(

Looking forward to the joys to come.

Orangesandlemons77 · 31/05/2024 10:39

When you get to the Appeal stage anything 'missing' you can send directly to them and they copy in the DWP. I did this and think it helped with the first appeal which was done on paper.

Orangesandlemons77 · 31/05/2024 10:47

Another option is to email your GP as they have contacts there. That can work if they start messing you around.
