HMRC Correction

ListenLinda · 02/08/2021 08:05

Hi all,
Hoping someone has some knowledge about HMRC corrections.
DH made a massive cock up last week, where they were going to over pay him by £1000.
Wage slip shows this and so does his PAYE on HMRC.
No wages went into the bank on Friday AM and they made a FP/CHAPS payment friday and his usual wage went into the bank Friday at 5.30.
However, he doesnt have an updated wage slip and HMRC is still showing the higher figure, which is going to screw our UC payment up next week and us (having had the pay the £900) in childcare today.
He asked them to make the correction with HMRC on friday and as of 5 mins ago, it hasnt been changed.
How long does it take to update with HMRC and am I right in thinking they legally have to update the info?
I’m seriously panicking as the UC is the money we live off as we pay all the bills out of our wages.

Ok, you need to ask his employer if a corrected RTI was submitted to HMRC showing the lower salary.

ListenLinda · 02/08/2021 13:46

He has asked them to make the correction. It’s still showing the same figure currently.
I’m seriously panicking that it won’t be done, our assessment period ends tomorrow.

He needs a definite answer if it’s been submitted, if it has you could ring/web chat HMRC and ask them to update the figures. Its pushing it for tomorrow though.

Some employers will correct errors in the following weeks’ pay run.

Comefromaway · 02/08/2021 14:20

I would have corrected it in the following weeks pay run but we don't have anyone on UC as far as I am aware so it would not have occurred to me.

Has your dh made it clear that this will affect his UC if not corrected immediately?

userxx · 02/08/2021 14:47

@Comefromaway I would also probably correct it the following week unless asked to do so. This is the problem with UC and RTI, mistakes happen.

ListenLinda · 02/08/2021 15:03

Yes he asked for it to be amended on friday, and again today.
They are paid 4 weekly.

When my wages office massively (on paper) over paid me, it really messed up my working tax credits. Even though my boss as well as me spoke with them to explain it was a wage office error and not mine, they still refused to pay the 2 weeks that I missed. I had to wait until the end of the tax year and then received the money then.
The wage error was so stupid as the clerk had put the decimal point in the wrong place and if it had been correct I would have had to have worked 24 hours a day 7 days a week for the month.

ListenLinda · 02/08/2021 17:37

His line manager had been told he would hear something within the hour at 3.30pm, but no news yet. PAYE online still showing the same figure and the corrected wage slip has also not been issued, I can atleast argue it with HMRC.
I feel sick, that’s our whole award gone and we had to pay an extra £100 in childcare due to his job.

This is bad news op, I hope you get it sorted out ASAP.

MrsJackRackham · 02/08/2021 21:40

The employer needs to send in an amended FPS showing the exact details as before with -£1000 as pay in the week or month. The £1000 needs to come off his record on his pay day not just his year to date figures. There's also a box that needs ticking to say 'correction' The employer's payroll software might not be able to do this however.
Best thing to do is contact UC and raise a payment dispute. UC then contact a specialist team in HMRC who will contact employer for confirmation, they then relay the info back to UC to update your claim.

danni0509 · 02/08/2021 21:42

Can you leave a note on your uc journal with a description of the situation, tell them you have Dh bank statement to prove his ‘usual wage’ is the only payment that went into the bank.

Ask uc to open a dispute with hmrc?

Hope you get it sorted.

ListenLinda · 03/08/2021 05:38

This would of been easier to sort if they hadnt stopped his payment and let the overpayment go through!
I’m finding it hard to believe that a major supermarket/high street retailer doesnt have to nake these kinds of corrections regularly.
I think I will leave a note on our journal explaining and see what happens today.

He did send an email last night saying if the correction isnt made they need to pay him exactly what was on his wage slip. Whether thats the right thing to do or not, who knows but we are in panic mode.

Even if they have submitted the APS to correct the earlier submission this can take up to 72hrs to show on HMRC system - given that yesterday was a bank holiday realistically you're looking at Friday before the system shows the update.

For UC however they will need to correct the relevant pay period not show a deduction in the following period as this would just cause extra hassle. You will also need to upload the corrected payslip & your bank statement showing the actual payment received to the UC journal.

ListenLinda · 03/08/2021 06:25

Yesterday wasn’t a bank holiday in England. If they did the correction Friday when asked it could update today but I don’t think it’s likely they did.
I have the bank statement but no wage slip yet.
So frustrating.

MrsJackRackham · 03/08/2021 07:28

Contact UC today and raise a payment dispute, don't just explain what's happened as that won't prompt any action. You need to specifically state you're raising a dispute.

ListenLinda · 03/08/2021 07:58

Thank you @MrsJackRackham I have raised an RTI dispute and I will call them today also.

OP posts:
MrsJackRackham · 03/08/2021 10:05

The HMRC team should pick it up quickly as I believe they don't have a backlog ATM. 🙃😉

ListenLinda · 03/08/2021 12:43

Universal Credit have said cant raise a dispute until it has been amended, or I can ask HMRC to amend. HMRC wont let us change it ourselves.
Still no news yet.

OP posts:
userxx · 03/08/2021 13:24

So the employer hasnt sent in an amended RTI/FPS ? HMRC wont be able to do anything until its submitted and updated at their end.

userxx · 03/08/2021 13:25

You're being sarcastic :)
ListenLinda · 03/08/2021 13:38

Just had word that the correction has been made in two batches and they cant confirm if he is batch 1 to be updated by the end of today or batch 2 by the end of tomorrow. Wage slip should be amended at the same time and we have asked for an email from his HR dept detailing the issue.

OP posts:
Timeforredwine · 03/08/2021 13:42

Someone i know had this happen, their employer corrected it but took hmrc some time to update despite contact so time went over and wasnt corrected until the next month.

ListenLinda · 03/08/2021 13:43

To be fair, HMRC updated very quickly on Friday.
Hoping it will be the same again.

OP posts:
Timeforredwine · 03/08/2021 13:43

UC cant do anything unless updated by hmrc
