What to do? Bailiffs coming for my car on finance

Hi all
(Will try to make a long story short)
Huge financial difficulties. Not earning enough to pay off debts. My car is HIRE PURCHASE. last payment end of May. Bailiffs can't take it but can clamp it and I don't have the money to take it off. I'm pregnant plus have a son in school and need the car for work
I have a parking fine that has escalated because I couldn't keep up repayments. Sent them my income expenditure but they don't care
Was wondering if I put my car into my mums name for the will they not be able to clamp it
Will this affect my mums credit or anything?
I don't know what else to do...
Any answers will be appreciated

Don't answer the door,park the car a few streets away from your house and contact CAB asap . They were hugely helpful to a friend when she was in similar circumstances.

I may be wrong, but I thought that they can only clamp a car that they intend to tow away and use to pay the debt - if your car is financed then they can’t take, so little point them clamping it?

@TyrionsNextWife they will clamp it and demand payment. And as it's illegal for me to get it taken off I won't be able to go to work or take lil one to school until I find the £381

Honestly OP contact CAB they mediated between my friend and they companies she owes money to, put everything on hold for a month while a payment plan was put in place. They want to come to a satisfactory conclusion because some money is better than no money.

This link says that they can’t clamp a car on finance, they can only take control of goods that you own outright.

You're classed as 'vulnerable' due to your pregnancy, if you show them quickly some proof they have to cease action for now. (I used to work for a bailiff company)

If they clamp my car and refuse to take it off until I pay, will my massive belly and pregnancy notes really get rid of them?!?

Get in touch with step change or pay plan. They will help you get everything manageable. They will also correspond with all creditors so you don't have to.

@anonymoooose Yes, there are times when they're not able to enforce against people and cause stress. I'd give their office a call and email in a photo of some proof for them to call the bailiff off

It’s called fraud/stealing etc. Pregnancy doesn’t make you a special case.
I have known hard times (father died when I was 13), when I had my DS mortgage interest was 15%. I roll up my sleeves and get on with it as no one owes me anything.

Is there a court order? Don't think they can clamp a car on finance. Have you spoken to CAB? Can you not walk/bus to school and/or work?

Bailiffs are complicated things in many ways. Although they should follow the law, they often don’t, and truth be told they won’t leave you be until they have the money.

Do you have any way of raising the money, OP? That’s probably a daft question but IME if you can pay some they will back off for now.

Try to borrow ,or extend overdraft or sell something,just to get rid of them ,the longer it goes on the higher the interest goes

If the car company goes insolvent due to people not paying their dues employees can lose their jobs. It could be you/relative/friend then have to go the employment tribunal fandango which is out of the public purse. I have been there.
It also means companies increase their costs to everyone (think of what happens re insurance)

I have tried to sell some of my text books from uni on most platforms but aren't having much luck. I've never been a gadget or name brand person so don't have much else to sell (TV is the 10 years old and no iPads or playstations about)

My income in 1627 and my outgoings are 2065 so trying to pay anything is really hard
Credit is bad so cannot get an overdraft
Work is 9 miles by car so walking isn't really an option (plus Id have to find money for travel card)
I won't be answering Jigsaw because she seems very insensitive. I was handling my debts and finances just fine before I went to uni. I don't want free handouts I just want the bailiffs to see I can't pay big chunks of money all in one go
My overall situation is making me extremely anxious and suicidal and her comments aren't really helping

They cant take away a car on finance but if you aren't paying the finance company then they can take the car back.

You've been given some good advice on who to contact for help, add the samaritans to that if you are feeling suicidal.

You have posted in a public forum, not everyone will feel sorry / have sympathy for you and as tough as it may be for you to read, people will post their thoughts / opinions.

Have you talked to your uni or students union OP? They should be able to help you out, at least with some guidance and information if nothing else. Hope it all works out.

Have you spoken to Stepchange, cab etc? If your outgoings exceed your income are you receiving all the help you are entitled to (childcare costs for example) or can you reduce outgoings as those do seem high. Agree SU may be able to suggest sources of help.

If the bailiff is sent by the finance company to repossess the car because you haven't been paying your car payments they can clamp and remove. The car belongs to the finance company until the finance is paid off.

If the bailiff is coming for other debts they can't clamp/take the car to sell for these as it belongs to the finance company. If you show them proof of the finance they should remove the clamp.

I have no advice as i dont have any knowledge of how baliffs work but coffeeandcake30 seems to be giving good advice and knows whats what...listen to someone who knows what their talking about...

@BrokenWing no it's not for the finance company. That is one of my outgoings but not one of the debts. I'm soon to finish paying for the car in May 🙂
