What to do? Bailiffs coming for my car on finance

Hi all
(Will try to make a long story short)
Huge financial difficulties. Not earning enough to pay off debts. My car is HIRE PURCHASE. last payment end of May. Bailiffs can't take it but can clamp it and I don't have the money to take it off. I'm pregnant plus have a son in school and need the car for work
I have a parking fine that has escalated because I couldn't keep up repayments. Sent them my income expenditure but they don't care
Was wondering if I put my car into my mums name for the will they not be able to clamp it
Will this affect my mums credit or anything?
I don't know what else to do...
Any answers will be appreciated

I was going to say you are vulnerable too.

They cannot take property from a vulnerable person or with a vulnerable person in the house. Your child is also vulnerable.

Write a letter to the bailiff stating this, put it in an envelope and blue tack it inside the door. If a bailiff turns up hand the letter to them through a window.

Keep a copy in the car too.

I'm off to see if I can find a letter template.

FTAO any debt collector.

According to Regulation 10(1) of the Taking Control of Goods Regulations 2013 bailiffs may not take control of goods in the presence of vulnerable persons.
According to Paragraphs 70 to 78 of the Taking Control of Goods: National Standards 2014 says a vulnerable person is defined as:
The elderly and infirm
A disabled person including a person with mental health issues
The seriously ill
The recently bereaved
Single parent families
Pregnant women
The Unemployed or anyone who is in receipt of a prescribed out of work benefits
Anyone who has difficulty understanding or speaking English

Ms X of Y (put your name and address here)
As you can see she meets many the criteria and legally you should inform the creditor of this

If you have debt that is owing to the council. Then you should contact the council explain your situation. They will probably say they can't do anything but you then say to them that you want a small portion I.e £10 to come out of your benefits each month. They can only except. I've had this before. I called the bailiffs and told them to hand the dent back over to the council.
Don't threat about it hun. They can't take your car and they can't come into your home unless you let them in.

Good luck with it all OP. Remember it's only money. It's super scary at the time but if you haven't got it they can't take it. My DRO ended in November and it's been a huge weight off my shoulders!

Great advice from @sashh above, too - follow up with your creditors and the bailiffs with that!

@JaniceBattersby I have done that before and one company found it! Was horrible. Walked for ages in the rain and the closer I got saw this massive orange 'earring' on my tyre. That one is sorted. But I'm sure there are more to come

@Hercwasonaroll I finished uni in 2018. I'm already working a 5 day week 8.30-4.30. Then I have my son. Working another job with mean finding more childcare to have him while I do that.
I'm thinking once baby comes I won't have to pay for the childcare anymore and the travel costs to work so that may help

@BadToast was looking at bankruptcy- not bothered about my credit because you're right it's terrible already but I don't have the £1000 to start it
Defo going to sell the car or SORN it once's it's paid off in May. Just to have a break from finding the extra money for insurance and tax and petrol. My mum is around the corner so it's a good idea

@sashh Thank you for that template. I will print out several to keep.
I have emailed the debtors with my pregnancy info and scan pics but they said they'd keep it on file but still want payment
I'm going to write to the council and tell them my situation also

OP you sound like you need real good quality support to get debt free and living within a budget. If this isn't the first car you've had clamped, you've obviously had money problems for a while. Get yourself in contact with an organisation who can help. Even if you wait until the car is out of the HP stage, then do it. £17k of debt isn't going to disappear.

There is support out there but you need to be prepared to access it.

Contact the CAB and they will talk you through your options, they might recommend a debt relief order because your debt is less than £20k, this only costs £90 and means you don't pay your debts for 12 months and if your situation hasn't improved after the 12 months your debt will be written off. It's not good on your credit rating but not as drastic as bankruptcy.
