Child tax credits and starting work

Hello, somebody please help me. From what I've read on the HMRC website, your current award for tax credits runs up until the April of the next year. If your income goes up, you can either tell them the change or wait until you get your renewal pack in April. Now, my partner was claiming jsa but has now found work, will child tax credits stop now he has signed off jsa? Or will we continue to recieve and pay back any that is owed next year? I'm worried they will stop as we won't see any of his wages soon as it is 1month arrears and obviously Christmas is coming so I'm relying on my tax credits and child benefit to tide me over until he gets payed. Thanks for any help xx

But you must tell them.

redsky21 · 21/11/2016 15:38

Personally I would take it as 30 days from when he starts getting paid. Yes he will have been working before that but won't have been receiving any money.

Piehunter · 21/11/2016 15:41

The award WILL change as it's based on your income, it's not all or nothing until you reach the threshold. Any change over £2,500 will change the amount you're entitled to. It's pretty simple. They share info with job centre anyway so you don't need to tell them, they'll find out in the next couple of weeks and you'll get a letter saying they're investigating your claim. However the fact you haven't told them might look like you were claiming fraudulently.

user1479732438 · 21/11/2016 15:52

Andnowitsseven, Thats what I thought too I read on one of their websites that the current claim runs until April. I'm hearing mixed reviews now on here.

i am not being rude. I am telling you what is on the website. You have 30 days.
He should have asked when he signed off what to do to cover the period from the last JSA payment to getting the wage. He didn't. So asking how he is going to resolve this is a valid question. You cannot call JSA and enquire because he was the main claimant, so he needs to do this. You cannot call his work and ask if they will give a partial payment (yes some actually do this).
No one on this thread has told you to wait until January. You may prefer not to hear the truth, but alas public forum and members can post wherever they like.
Chances are the claim will NOT stop because the threshold has not been met. If it has there are other option which they will talk to you about.
However, as soon as the JSA informs them, the claim will stop, potentially for up to 16 weeks whilst it's investigated and this will be before January.
Everything is linked via computers, and unlike years ago, it's not paperwork that takes several weeks. Depending how busy everyone is, this can take up to 2 weeks.

user1479732438 · 21/11/2016 15:54

So for example if somebody had started a job that earned even £50k, would that mean you would continue to recieve the tax credits up until April when you renew your claim? I'm so confused about it all now

OP posts:
user1479732438 · 21/11/2016 15:57

Yes, a previous poster said to wait until January to tell them...

You have confused me further, you said it will not stop as the threshold hasn't been met but then you say that it will stop as jsa will let them know his claim has ended??

"you may not prefer to hear the truth" I really feel that ypur wording is really rude, there are mixed opinions on this and I'm asking the question as I have read that your current claim runs up until April.

You need to tell them straight away, your payments will not stop. We went from ESA to working earning similar to the salary you mentioned, our payments did not stop and we were entitled to working tax credit until april also as they will only take dec-april income into account for calculations as that is all he will earn this tax year. Our working tax credit was £96 per week child tax was £168 per week (we have 3 dc).

Nooneofnote · 21/11/2016 16:07

Ring them with

A) the amount of JSA he's had so far this tax year
B) the amount he expects to earn between his work start date and 5th April 2017
C) his employers name and address and how many hours he works.

They will then recalculate your award and you will most likely get CTC and WTC between now and April. So your money won't stop, it's much more likely to increase until April.

It will be up to you to call them after April and give the new higher estimate for the whole year of 30k.

What you get will then significantly reduce. But the longer you put off telling them the higher your overpayment will be

user1479732438 · 21/11/2016 16:08

I have a toilet brush, did they put a hold onto your claim while they recalculated it? I have always been under the assumption that you aren't entitled to any benefits unless you are on a low income, hence why we have only ever claimed from august this year! So we would be entitled to working and child tax credits even on his salary??

OP posts:
Nooneofnote · 21/11/2016 16:11

You may be, on a salary of 30k he only going to be earning 10/12k THIS TAX YEAR depending on when he started.

Added to the contributions based JSA it will probably mean you are eligible to WTC and CTC until April

It will all change after April when his full 30k will be taken into account

IHaveAToiletBrush · 21/11/2016 16:12

No the extra payments came 3 days later then again on normal day, so infact we had 2 payments in the first week. You just need to work out salary between now and April and say that is 2016/17 tax year annual income, they did not take our ESA payments into account.

IHaveAToiletBrush · 21/11/2016 16:14

You will be entitled until April 2017 to both working tax credits and child tax credits. We also got 4 weeks full housing benefit as a roll on payment why they calculated our new entitlement.

bloodyteenagers · 21/11/2016 16:19

The wording isn't rude. You are choosing to ignore what is clearly in the link about the 30 days. Several people have also said you need to do this ASAP.

the previous person said You won't be able to carry on claiming and then informing them in January, it's pretty obvious that you need to do this now.

It won't stop because you are calling them about a change in circumstance. However, JSA automated thing will tell their automated thing the claim for JSA has stopped, so the computer will stop the claim. Same with Housing benefit and council tax. You wait for the computers to talk to each other, and potentially no tax credits for up to 16 weeks. They will also possibly want a ridiculous amount of paperwork going back at least a year at your expense whilst you are investigated. Plus tax credits, housing benefit and council tax will all demand over payments from you, and as already mentioned fines.
However, you let them know and any adjustments will be made without a break.

user1479732438 · 21/11/2016 16:29

My partner signed off last week, would they have already informed tax credits?

OP posts:
user1479732438 · 21/11/2016 16:40

Hang on a second, I have just read that you cannot get working tax credits if you are a seafarer or offshore worker... my partner is a seafarer and will be working 3months on 1.5 months off, what would this mean about working and child tax credits?

OP posts:
user1479732438 · 21/11/2016 16:49

Would I be entitled to anything by myself until April??

OP posts:
Babyroobs · 21/11/2016 16:51

Op, on a salary of £30k you won't get wtc ( well you may this tax year if your estimated income is lower than £17k), nut next year you won't. The threshold for 2 kids is around £32k, so after April you will get a small amount of child tax credits and no wtc. Sorry I have no idea bout the seafarer issue. I very much doubt that your tax credits would stop straight away as there is no way that your household income would be near the threshold this year. They may reduce but they won't stop. I would tell them of any changes asap so that you don't have an overpayment.

bloodyteenagers · 21/11/2016 16:52

Depends where he will be working

Babyroobs · 21/11/2016 16:53

Why would you be claiming anything for yourself? if you are a couple, you claim as a couple.

user1479732438 · 21/11/2016 16:56

Babyroobs, I will speak to my partner tonight and phone them and speak to them asap. Really worried now about the seafarer thing now invade I'm not entitled to anything, unless they let me do a single claim as he will not be in uk

OP posts:
bloodyteenagers · 21/11/2016 16:56

This is why you need to call them so they can go through everything with you.
It might be that his claim is closed and you have to open a claim.
Everyones circumstances are different.

user1479732438 · 21/11/2016 16:57

Babyroobs,It says that your claim will stop if you are out of the uk for more than 8 weeks, so I'm wondering if then that'll mean that I would have to claim for myself as he won't be here

OP posts:
user1479732438 · 21/11/2016 17:00

He won't be working in the U.K., will be over seas
