Do you think they will empty my account ???

I have a loan with Barclays and up until me and P split, I was paying it every month no problems.

When we split I started to struggle alot. The payments were £105 a month and I just didn't have it.

I rang and asked if I could change payments to £70, by basically redoing the loan, and they said yes but later changed their minds and said it had to be £90.

I agreed to the £90 but was still struggling.

Anyway, I have now defaulted and I knew I was going to, but tbh I'd rather it go to court, so that I can make an offer I can afford and not be told off for it.

Problem is, my account is also held with Barclays and in one of the letters they sent, it said that they could take money from my account if it were in credit. The only money I get into that account is my benefits, so there is never alot in there, at the most there would only be £200 which happens once a month when my CB and IS is paid on the same day, but it soon gets taken out again.

Would they be allowed to take it if it benefits money ??? Also are they likely to do it seeing as my account is normally only about £50 in credit ??

I'm sure they can. The earlier you call them the better your chances. I've changed bank accounts really easily for child benefit so just tell them the account is closed and they need to send it another way?

If I remember correctly child benefit say they need it in writing and then they can make a manual payment. Tax credits can do it over the phone.

Well have just done my income and expenditure for Barclays and the amount left each month is £60.56, so I will be offering £60.

I think they will say no but that is all I have left, thats it.

I fucking hate barcleys, they stitched me up years ago. Have you tried Lloyds? im with them and i cant even get a catalogue, im blacklisted to high heaven.

Can you not offer £50, then at least you'll have a small contingency for emergencies. Do speak to someone before you go back to Barclays, as to how best to approach it.

Oh meant to say I had spoken to CCC and they have said for me to offer what I can and then if that fails the worst Barclays can do is take me to court.

Someone on another site has just PM'd me to say that she had the same problem, she let them take her to court and because she was on IS she only pays £5 a week.
Surley then it is in Barclays interests to let me pay £60 or £50 even ??

I will offer £50 then LIZ but they told me earlier that whatever it shows that I have left, I have to offer.

If they don't accept, I am going to see if I can stall them until I can open another account I think.

I have to ring CCC back tommorow to let them know what happened and they said they will then advise me of what to do next.

I do want to pay, and £50 a month is fine with me, but heres betting Barclays don't agree.

Oh also meant to say, that I have been advised to move my tax credit payment to someone elses account at just gone midnight on tuesday, which I will do if I get no joy tommorow.

Morning, just to let you all know that I rang Barclays this morning and they eventually agreed to put me on some special payment thing were I will only pay £39 a month for 12mths. After the 12mths it has to go back up to £80 a month or it is passed to debt recovery.

Cheeky bugger asked why there were quite a few paypal payments on my account, so I told him it wa because I can't afford to buy my kids new clothes, and he soon shut up then.

So thats that, I feel alot better about it and hopefully if I can get a flippin job I will be in a position to start paying £80 in a year.

Nutty, can you put the difference between the £39 and the maximum you think you can afford into another account? Somewhere you can still get at if you need to but so you've got a safety net for when the payments increase next year.
