Do you think they will empty my account ???

I have a loan with Barclays and up until me and P split, I was paying it every month no problems.

When we split I started to struggle alot. The payments were £105 a month and I just didn't have it.

I rang and asked if I could change payments to £70, by basically redoing the loan, and they said yes but later changed their minds and said it had to be £90.

I agreed to the £90 but was still struggling.

Anyway, I have now defaulted and I knew I was going to, but tbh I'd rather it go to court, so that I can make an offer I can afford and not be told off for it.

Problem is, my account is also held with Barclays and in one of the letters they sent, it said that they could take money from my account if it were in credit. The only money I get into that account is my benefits, so there is never alot in there, at the most there would only be £200 which happens once a month when my CB and IS is paid on the same day, but it soon gets taken out again.

Would they be allowed to take it if it benefits money ??? Also are they likely to do it seeing as my account is normally only about £50 in credit ??

a long long time ago. i opened a seperate account with barclays in my maiden name - for saving.

we defaulted on a loan - and they took my savings to cover it - was only £200 - but at the time it was my whole world.

so if you have spare cash - draw it out - put it under the bed or inanother account - would be my advice

Why wouldn't they take it? It's money, it's in "their" bank. Where it came from doesn't matter.

I agree with you Soupdragon. They aren't bothered where the money came from only that there is money in the account and they take what they need to pay their debt.
Have you rung the debt collection to ask about agreeing a new repayment you can afford ?

When I say I have NO OTHER MONEY, that is what I mean. My ctc goes in on wednesday, by the time I get to a cashpint, it may well have gone.

I have rung barclays again, and i have to ring them tommorow with a new plan, but I have been wraned that they will not accept £70 a month so basically I am stuffed because quite frankly £70 a month is too much too seeing as I can't even afford to do a bloody food shop lately.

Basically, the only way I can stop them removing the money is to ring up tommorow and yet again agree to pay an amount each month that I know I cannot afford.

Any attempt by you to offer a reasonable amount will go in your favour should they pursue it to court (where I think you will find your benefit income being taken into account). Make sure you document your offer, but don't overcommit as you'll just fall foul of the system when you next miss a payment. Please go to a CAB or phone one of the charity debtlines asap for proper advice as this situation won't go away and better to make a clear but affordable arrnagement now than struggle on.

I really don't get why they don't accept people's reasonable repayment offers. It's ridiculous - they'd at least get their money that way rather than the person defaulting. And if you're going to get screwed by not affording the repayments, I guess you may as well be screwed for not paying at all.

I thought they had to accept a reasonable offer though?

I dunno the rules, they seem to change every time I speak to them.

I was paying £104, offerd to pay £70, they said yes set it up for 2 mths and I paid. After 2 mths they stopped taking the money and so I rung and said why and they said £70 isn't enough, you must pay £90 etc etc etc, and it goes on.

The woman today said I must include everything in my expenditure, but I mean, say if i put down £25 a month for Dd1's ballet, they are really gonna count that as stuff I need and take it into account ????

Have they not asked for income and expenditure.
Do you still have a direct debt set up for the loan pay.
Pay them the amount you can afford whether they say they'll accept it or not.(This shows that you have tried to make payment against your debt)
They very rarley return money because it's not enough.
Try and get a different bank account.
Your debt will probably be passed on to another collection agency who will accept lower payment.
I hope this makes sence.

Also its a myth of being black listed, either name or address, theres no such thing, theres 3 major credit compaines who run checks, Experian being one of them, they use a points system and its up to either of these three companies wether they grant you credit or not so don't worry about that nutcracker, if you are really worried about your bank taking the money call up Child Benefit to see if they could temp give you the money another way, or go and open another account at a different branch like Alliance &L and then call child benefit to transfer it into that account, it only takes a week for child benefit to make the changes

yeah they dojtn care about starving kids - they create them in other countries! withdraw your money. go to cab. get them to fill in an income / expenditure form to give to bank.

as far as i know your offer of £70 is plenty generous. so see cab to make sure of facts. barclays want to make an agreement with you ring them up tell them you have been informed that the loan is nota priotirt debt and unfortunaley the council tax want money off you as well as your rent ans student loan or your going to prison ( what the fuck do they know? they dont) so you can only pay then forty quid now.

see if they say " we can only possibly accept "70"

Good point Custy, I think I will say I can now only afford £50 and I'm sure £70 will then be fine.

TBH If I had managed to open another account today then I wouldn't be ringing them at all. If it went to court,I know they'd let me pay a hell of a lot less than £70 a month which would be fantastic.

I am still going to open another account anyway, just for my own peace of mind.

i am black listed to the hills.

but i got a basic account with royal bank of scotland, it is just a card account, and i have dd coming out of it,

the debtline do a list of accounts you can open with bad credit history

Nutcracker-Have you tried the alliance and leicester.
I managed to open an easysavers account with them
which i have my CB payed into.You just get a sppedbank card and can withdraw the money anytime.

Also barclays could take the money from your account even if it is CB.They did it to me and left me with no money for the month.

I would try and get a different bank account set up and you can contact the child benefit office and ask them to send a cheque for you to cash at the post office until you get another account sorted.They did that for me and then i just let them know my new account details when I had them.

Californiifright - that was reason I asked if Nutcracker has a direct debit still set up for the loan. I would suggest you cancel any direct debit and if you have access to on-line banking you can do this on-line.

Any payment you make should be done by standing order or a payment slips.

Nutcracker-I'm not sure if I'm understanding correctly but is there anyway you can stop your benefitsbeing paid into that account? Can you call the benefits agency and get them to pay you another way?

Ask if they can make manual payments until you have a new account. Tax credits did it for us when the bank account was frozen. I think Child benefit will do this too.
