Any mners who understand bankers drafts..I think I have been very naive!

Can anyone offer me any advice?

I sold my car to a guy who lives in Hull (I am in Derbys). He came to view on his way to his job in London, the following day made me an offer, sent ?75.00 through paypal as a deposit, then promised to collect the following Saturday with the remaining cash.

Me, being helpful! offered to drive the car to Chesterfield as this would basically cut around 3 hours off his journey, to meet his train.

He arrived with the cash, and a bankers draft for ?150.00 which he said was because the bank wouldn't allow the full amount in cash. This would have been fine but he had "mistakenly" had the draft made payable to my email name not my true name. He apologised and it did seem a genuine mistake to make, so I let him take the car, and I rang my bank on the Monday morning.

My bank told me that I would ghave to get it changed to my account name, So I rang the guy who told me to send it back and he would get it changed.

I sent this back to him, well over a week ago and he is saying that he hasn't received it??

How do I stand? Can bankers drafts be stopped on his behalf?

I am very worried I have lost this ?150.00.

I was so trusting that I didn't even record delivery

Any advice?

When I was buying a flat about 10 yrs ago my solicitor lost my banker's draft for my deposit I spoke to my bank who siad though it couldn't be stopped they could put an alert out and this should stop it being cashed. However should it slip through I would be liable for the amount. It never did reappear and I think my solicitor probably shredded it when he did find it - the asswipe!

I was just so stupid to think that as it didn't bear my correct name that the draft wasn't worth anything.

It never crossed my mind it was going to be a way the buyer could get out of paying me the extra £150.00

did he ever send you a mail from that address (otherwise, tis prob fake)

have you checked his address out (online)?

He sent emails from this address, and I replied to this address, this was when I was helping him with the train times and arrangements etc.

This week every email I have sent has come back to me as undelivered.

He is obviously seeing my number on his mobile and ignoring the calls too.

He did ring once from a landline that I didn't recognise the STD code 01482.

its looking like youve fallen prey to a seasoned conman, i suspect that the email address was temporarily set up...did you fill out the registered keepers document to send off to the dvla notifying them of a new keeper?

Oh, and everyone else, please please please don't take bankers drafts. It's impossible that a bank would say "you can't have cash, but you can have a banker's draught".

01482 is the area code for Hull.

I still have the v5 with the intention of sending off when I got the money.

Last week I had a letter from DVLA advising me that he applied direct for the new v5! They have to release this as they say its not proof of ownership only who is using the car.

My husband said I should have sent it off anyway as he could have gone through speed camera's or such like and if my name was still on the v5 I would be liable.

I would call DVLA and just let them know what's going on. Surely if you haven't sent in the paperwork, you can claim the car has been stolen?

you should send the v5 off straight away as your husband is right, he could clock up speeding tickets etc and you would be liable.
bloody cheek that hes applied direct for the v5.
did he fill out his name and address on the tear off slip of the v5

Well it has a contact us section. Ring them up and ask to speak to the guy (give a false name) or email them and ask for their office address so you can send your letter about legal action to him at work
