what a complete nightmare

dont know if anyone has been in this situation or can help me, couldn't sleep for worry last night. well yesterday all excited about to pick up my new car and was part ex my old car, when i say old is a 2002 model so not that old. 15 mins before going to get our new car the garage rings and tells us he has done a hpi check on our car which come back saying our car was a cat b write off which means the body shell of the car to be crushed and the vechicle never to be returned to the road.Shock we went back to the garage we bought it from and he is looking into it etc etc. so in the mean time i have no car and a car sat on my drive that is worthless. anyone had any experience in this please help me going out of my mind. thanks sorry for rambling.

Never had this happen no. But surely there was an hpi check done on it when you bought it?
Maybe its a mistake. Plus when you registered it with the dvla wouldnt that have brought something up too, or am I wrong?

when you go to hpi check it says what happens if it brings something up click on that!

no hpi check done on it when bought, we thought we was buying from a good well known dealer and just didn't think of it. spoke to hpi people yesterday they said its been done as a write off by the cars chasis number and not the number plates and the log book has obviously never handed in and it slipped thro the net.

i have done one of those yesterday because i thought the garage had it wrong. it come nack saying my car was a category b write off which means the body shell should have been crushed and the vechicle should not be on the road in any circumstances.

i have been so stupid not getting a hpi check done but when you buy from a dealer you expect it to be all legal etc.I have been driving round with my 9month dd in the car since she was bornShock

Sorry to hear this.
The 'old' garage should have hpi checked your car, at the time.

Plus, remember that you have been driving around in an unsafe car, for as long, as you have had your old car - and that is not cool at all !!!
What is the'old' garages response to that, then ????

Yes, you have lots of rights.
Stand firm and don't let them get away with it.
Also, demand a quick response from old garage.
You do not want this to jepodise receiving your new car.

i wouldn't of known either tbh especially buying from a dealer. they say you learn from your mistakes, well you certainly do.

i have lost new car now haven't got money to buy it and cant expect garage to keep it for me. i told the old garage i wanted a answer by today and he told me not to make him idle threats and he will sort it out. he rang yesterday afternoon when we got home saying he wants to come and inspect the car. do what he likes but it cant be driven any were.

the thing that makes me laugh. well not really makes me Angry as we only bought the car because i was pregnant and thought it would be a safer car for me and my unborn dd at the time. what a joke!!

I'd ring Trading Standards. Although it may not ultimately change your situation the garage you bought from (in good faith) should have checked it for outstanding credit and status before selling it to you. If they are reputable then a call from TS might provoke a gesture of good will.

what a nightmare. you also need to speak to your insurance company as this will most likely void your insurance policy, best to cancel it and get as much of a refund as you can atm. good luck

well maybe getting somewere at last the old garage have rang and said they need car for inspection now. dont know what they will do with it. then if they find evidence of a accident they will pay out. so fingers crossed.

we spoke to insurance company yesterday and we are not insured so cancelled it and they have given us money back thank fully.

the car was a write off, why ois them inspecting it going to maek any differnece?
i don't understand....
just tell them you are seeing a solicotr and will be expecting them to refund you the money. Or go to the papers, they love stuff like this

i agree, they are sounding q dodgy tbh,
surely all he ahs to do is to look at the paperwork that says the car is a write off?
not to look at the car itself?

they have also told me i wont be getting back the full amount that i paid for the car because i've been driving it round for a nearly a year. does anyone know if i rang dvla would they do anything?? i dont want the garage having this car back and sell it on again.
