Can money be taken from your account if you no longer have the direct debit set up??

If you once had a direct debit set up to pay something but it no longer appears on your account yet you still owe the company money, can they still just take what they want from your account??

Also can Barclaycard do this if you have a Barclays account and owe them and they see you have money in your account?

if you phone up and cancel the dd then I don't think they can take any more money out without setting up a new one

barclaycard is a different company to your bank account (same umbrella group of course) so I don't think they will have access to your account to know if the money is there or not

BUT

if you owe someone money I would make sure the money is there to pay them off - because you will be liable for it if ever they come up to you and say 'hello where's our money' they may also ask for interest

nutcracker · 21/11/2005 16:49

Barclaycard can yes cos they did ti to me.

I owed them from when I had a credit card with them.
When I got a loan about 18mths ago, they took what they were owed cos they had a had a thing on my account the whole time to let them know when there was enough money in there.

Zephyrcat · 21/11/2005 16:59

Hmmm so must be them then. B*ards. 1000.00 has disappeared from dp's account - basically our rent

can you not get a statement or phone up your bank and find out where the money went rather than guess?

Zephyrcat · 21/11/2005 17:01

Yes he's going to to try and get in tomorrow to speak to them - i just wanted to find out if money could just be taken without being authorised so to speak

Did you actually cancel the direct debit with the bank? If so, they should not be able to take money out (under the auspices of the old direct debit).

Did you ever sign an authorisation for taking out money from your account to your credit card? If you didn't, they should not be able to touch your money.

we'll have to find out when he goes in - but thanks - that's the kind of things I need to know to tell him to ask as he'll just get wound up and do it all wrong lol

We had an original dd set up with barclaycard aaaaages ago but they took 300 the other day out of the blue and now a whole heap more has gone.

No they can't.

You need to find out what's going on zephyrcat because it all sounds a bit suspicious.

foxinsocks · 21/11/2005 17:12

was it definitely them that took the money?

When he speaks to the bank, he must complain because if he cancelled the old direct debit, they should not be allowing them to take money out.

Do you have online banking? You can check what direct debits/standing orders you have set up (it's a good idea to do this every now and then anyway just to check what's going out!)

He hasn't got online banking or phone - I think he did have a pin number sent for it but has never used it and doesn't know it. It's only a basic account so it can't be a credit card etc, he only uses their cashcard so it has to be something that has access to the account - we'll find out for definate if it was them tomorrow. Hopefully he'll be able to set it up so that they allow me to speak to them about his account because he can't get out of work.

God I hate barclays!!!!!

Barclaycard are perfectly entitled to do this I'm afraid - it will say so in the small print. It's nothing to do with the direct debit (when you cancel one of those they can't take any more money).

I would change banks then!

foxinsocks · 21/11/2005 17:31

This is what I meant when I asked about the authorisation thing (it is sometimes in the small print) but they should have pointed that out to you I would have thought. V poor!

bunnyhops · 21/11/2005 17:56

This happened to me with Lloyds TSB .I had a credit card and got behind with payments and they took the money from my account without letting me know. The money that had gone into the account was my child benefit money and I rang them to say I need that money for nappies etc, basically they where no help and the girl got quite snotty with me and said there was nothing they could do.

bunnyhops · 21/11/2005 17:59

I should have added I changed banks.I had been with them for 14 years no problems and as soon as I got in a bit of trouble fianacially they did'nt want to know.So much for customer loyalty.

Zephyrcat · 21/11/2005 20:52

Well dp rang them when he got in and it was Barclaycard. They had taken 300 to start off with then decided to have another 500 as well!!

DP had a bit of an argument with them and was told that today was his last chance to call them (although he's been ringing them for 2 days but everytime he types in his barclaycard number on the system his call got disconnected!!) so he has to ring again in the morning and it'll get sorted.

Soon as it is we are as far away from Barclays as possible with the grief they've caused us lately!

The Banks that issue their own Credit Cards always have a Right of Set-Off in the Terms & Conditions, so that if you fail to meet repayments they can demand any credit monies from a current account. Similarly, if you default on a loan & funds arrive later in month, Bank will take payment as soon as it can.

Zephyrcat · 21/11/2005 20:59

We had no idea about that - guess we should have read the small print! But still think it's a nasty thing to do when you aren't prepared for it.

I'm surprised that they took it if thats all that was in your bank, thats really bad. When they took mine, they took it because they could see that there was more than enough to cover it.

I argued with the woman on the phone, but tbh now I'm glad they took it cos it's one less debt i have.

bunnyhops · 24/11/2005 08:57

Zephyrcat-Was just wondering how you got on with the bank?
As I said previously we had to change banks due to the same problem,it is so wrong.

Zephyrcat · 24/11/2005 11:36

Hiya - turns out they took 865.00 so we told them that was all our rent money and it was due yesterday so we needed it all back. They made us fax a copy of our tenancy agreement which says 600 a month payable as 1800 every 3 months. Barclaycard decided that we don't pay 1800 we pay 600 and because I live with him I should be paying half anyway so they've agreed to put 600 back and kept 265.00 and arranged to take 100 every month - except as soon as the 600 is back dp is going to close his account How the Hell can they 'assume' what rent we pay when they've got it in black and white - and then tell him that I can pay the rest!?!?!?!?!
