Child tax credit ....they wants lots back!! Please help

I've just had a letter to say they have over paid me by £2830!! I don't know why!
But just finished a contract and now claiming JSA I can't survive without child tax allowance and they want me to repay by June. Can anyone advise me what to do?

Call them and tell them the situation. You can also need to find out why and query this.

They have to allow at least 2 years to repay. Longer if you submit a financial expenditure form. They are bullying you. Ime it's best left until they pass it over to their overpayments section. They will contact you.

Speak to them. The system is designed to overpay you They wrote to us telling us they were going to claim it back and it was taken out of our bank account in one go. Then the letter arrived

Can you give any more details? I understand if you don't want to but it's difficult to help with such little information.

I had this and I still they were wrong but it was nigh on impossible to get any sense tbh.

Thank you for your replies. Not much more really to say. Am single working mum.. but just been dismissed due to long term sick, so about to claim job seekers and have no money! Can't see how I've been over paid. No maintenance ☹️...working on that and two teens to keep afloat. Have been banking on next payment to get me through... looks like that's not going to happen! Will ring them tomorrow but could do without this added stress!

Ring them and offer to pay back £10 a month.

Ask for all the details they have on you and why they think there's an overpayment.

They're bastards. They said I owed them £9000 because I didn't tell them about my new job. I did, I could tell them the exact date I made the call. They kept denying there was a call made, then said there was, but they wouldn't listen to it - id have to appeal, which would take up to a year, and wouldn't get paid until then.

I wanted to die I was so scared me and DD would become homeless. My MP tried to get it sorted as best as he could. What really helped (after advice from MN) was emailing the chief exec. About a week after emailing him, I got a letter of apology back, said I was right, wrote of the (imaginary) debt and they gave me £50 to say sorry (which was a bloody insult tbh).

So try them, ask for the department which deal with vulnerable people (I can't remember the name but they'll know if you say that - they should offer it to you automatically but they don't. They asked me very suspiciously about how I had found out about it - I actually knew because a HMRC worker messaged me on here about it). They will run through a payment plan for you which will help in the short term. That should get sorted within a few days. In the longer term, if you don't actually owe anything get onto your MP/ chief exec.

Now going through the same bloody thing with housing benefit. So will have to annoy my MP again, and get onto the head of the council. It does work, I promise. I swear they just try to take advantage of vulnerable people who don't know the processes (because they're not publicised). I've always been completely transparent and honest about the money I earn. I can't bloody wait until I earn enough to not depend on these awful government departments who treat you like you're an idiot, and a sponger.

Oh, they'll ask you why you're vulnerable. Just say you're an unwell, single parent. This department has very strict guidelines to follow. Not like the general phone line people who are no help at all.

Don’t panic!! I had a similar bill. No idea why as I was totally honest. Think the system is just rubbish.

But don’t panic. I rang them and they agreed an amount each month by direct debit- think it’s goinf to take me 4-5 years in total to pay it back but it’s an affordable amount.

Phone them. I have an overpayment of nearly 3k (part their cock up, part my cock up.)

I phoned them, told them that unfortunately I do not have 3k available by the end of May and that they could have £20 a month.

The chap was a bit Hmm but set it up nonetheless. I intend to up the payment when we can afford to, but, the point is I called him, it's on file that I'm making an effort to pay and all is fine.

6 years it took me - to get them to admit that I was paid the right amount and owed them nothing at all! They paid me in the end - a couple of hundred for phone calls and time spent sorting out their incompetence. 6 years of phoning at least a couple of times a month, 6 Loooooooooooonnnnnnnnnnnnngggggggg years....

Yes, call and set up a payment plan! They sent us a bill for over 2k. I called and offered them £30 a month. They first person couldn't authorise it but they put me through to the financial person who just got me to confirm that was the most we could afford and they approved it without any bother. Just offer £10 or £20 and insist that you cannot afford a penny more and they will likely just accept it. They won't win in court if you are willing to pay something back.

Firstly, is it child tax credit or working tax credit they are claiming to have overpaid?
Do you usually get any help towards childcare?

I got a letter saying I owed £2000, I just rang and offered to pay £25 a month but I know others pay less. I didn't have to fill anything in.

Yes it's child tax credit..oddly I was getting that and working tax credit and now only working tax credit. It just stopped even though nothing had changed. Thanks I will ask for a payment plan .. does that mean I get nothing until it's payed off?Confused

No OP. They will take it out of your tax credits. It seems other posters have had an easier time than me, but read my other thread if they are not so easy to deal with.

Get to citizens advice and speak to someone - they told my friend she couldn't have any more payments until she'd paid them back the overpayments (which was their error not hers she submitted her payslips etc) but they apparently can't do this. She offered them £1 a week with a carefully put together income/expenditure form they had to accept it - good luck and I'm very sorry to hear you're in this stressful situation Thanks

First have a look at the letter for any deadline to challenge the decision and how you have to do that.

There are two separate issues here

  1. - have you been overpaid tax credits, if so why
Have a look at the letters to see which years these relate to. See if you can work out if there was a change in your circumstances. If there was did you tell HMRC and when? It is possible you haven't been overpaid
  1. Should you have to repay?
If you were overpaid because HMRC did not act on the information you gave them (as long as you reported within the deadline) then you can argue whether you should pay back at all. You can also argue based on hardship. If you will be paying back then there is the issue of how fast.

I volunteer for CAB who may be able to help. To make it as easy as possible for them and yourself see if you can get the papers in date order. You may also want to clip the pages together as they all look very similar.
If you have been overpaid they may be able to help you negotiate if you want that help. (Each CAB is independent and has different resources so different levels of help.

Thank goodness as have gone bankrupt this year as EX walked and left me with £30k debt .. all in my name as he was a 'mature' student. I get nothing from him... MH problems and not working. Teens both at school . Just ant seem to get a break atm! But so thankful for all your help.

I owe a big amount to tax credits, above your amount Blush. They just take about £10 off my existing payments so I actually don't notice it missing but it will take a long time to pay back, I know a lot of people who have had overpayments but none have had to pay it back in one go and most either pay a small amount direct debit or some off their existing payments so don't panic.

If you don't have plans in place to deal with the debt then CAB generally have debt advisers or can signpost.

Please find out that you owe them before making a payment plan.

They can often be wrong. I would ask for an explanation before parting with any money.

Absolutely what Guardsman18 just said - ours (the 6 long years one) was NOT owed, we categorically knew we did not owe them, they were adamant we did (but we can use a calculator!) hence it took 6 years, we paid nothing - they paid us for our troubles and we got a letter from the ombudsman assuring us that "things would change" hahaha...

Do not offer to pay unless you KNOW that you owe them.
