How to get relatives car off my property

Avacadosprinkles · Yesterday 16:07

A relative has left their car in my garage for the last 10 years. I want to sell my house and they won't move it. They could move it to their own property but don't want to. It was always meant to be temporary. I have brought it up several times over the years and they just brush me off with excuses every time. I have ran out of patience. What legal route do I need to take. I don't want to dispose of or sell the car I just want to get it towed to their driveway, but Google seems to suggest I could be prosecuted for criminal damage if I do

mate, why aren't you asking a solicitor, not Mumsnet?

I am planning on it, but wanted to know what legal process I'll be asking for

If you have given formal notice that they have to move the car with a deadline, had it done by a reputable company and taken a shed load of comprehensive photos/videos of it before, during and after it's been moved, how can they possibly come after you for criminal damage?
I would just send them a digital copy of all the evidence from the day and let them fill their boots.

Park it on your drive with a For Sale sign in the winows Put relatives number on it ..text relative and say if it hasn't sold in a week the sign will change to FREE ..

This is actually a bloody fantastic idea. The OP is not moving the car illegally and it has to get the owner to get the finger out really

There is an easy route to deal with this. Spend a little money and get a lawyers letter sent to them advising to uplift their car by X date and the consequences of failure to do so which the lawyer will insert. You are then covered as you haven't moved the car, rellies knows you are serious as you have instructed a lawyer and they have also been informed of consequences of non compliance. You can then sell your house free of the car. Good luck

I’ve heard If you say alluah Akbar in front of the car three times it disappears

PropertyD · Yesterday 19:40

Is this an older person we are talking about. It just sounds like all the faffing around is someone that doesn’t really want to move it. No where to put it and it’s bloody annoying that after 10 years you want to sell your house- how very dare you! If you sell it and the new buyer won’t know it’s someone else’s car then they will HAVE to move it. If you sell the house and you exchange then unless they come and collect it you will get it scrapped.

They could also be someone who doesn’t do anything unless they really have to

No

How can it be insured if its not on his property, is it included on your insurance. Just get a solicitor,to write to him, recorded delivery and email, giving the minimum statutory notice to remove it.

as I tried to show- you haven’t responded- it’s not so much the legal bits that you are so focused on - much like a quick fix you are after( the legal
bits will take care of itself), but exactly what’s going on. Unless you want to reserve that for your solicitor. Otherwise what is your Q?

No, that’s not what you ask solicitors.

Who owns the land, is it you?

Puzzledandpissedoff · Yesterday 19:44

I just want the legal solutions. Torts doesn't quite fit the bill as it it disposal or selling only

What exactly is your objection to going down the disposal/selling route, @Avacadosprinkles?

I'd have thought the main objective is to get the blasted thing gone, and if that's what it takes - and provided they're given proper notice of course - I can't quite see the problem?

Yes I own the land they own the car

And this will be a man. You have a car for 10 years and you never drive it..what a waste of money. How far do they live from you? What are other relatives got to do with it?

Have you given permission for him to store the car there?

Mumofoneandone · Yesterday 19:47

Lots of good advice here but I'd consider charging rent for the space........ might encourage them to move the car!!

I did initially give them permission on a temporary basis. No firm dates given but expected to be gone in a year or so

AgonyAuntsortof · Yesterday 19:48

Argh, is it a former partner or ex DH? Did you buy them
out? Or something similar? Explains the secrecy!? Explains everything, actually! And ehy this is the crux of the matter, as I quickly worked out!

good luck. Don’t expect judges to give you a quick fix, unfortunately!

This is a good idea. Not clear how you can move from gifting space to charging for it, but enforcing the non payment of rent charged, would then help!

Kidsandhouse · Yesterday 19:51

#1 Put the house on the market.

#2 Tell them it has to be moved within x days

#3 Tell them if it's not moved within x days you'll go the legal route. (Whatever that might end up being doesn't matter yet, so no need to wait before doing #1)

AgonyAuntsortof · Yesterday 19:52

It’s why when it comes to things like this, better not to help in the first place. Seen things like these over and over again. Some through genuine changes of circumstances but a lot through not caring or greed or entitlement.

this person here seems entitled to this space. There must be a reason for this, surely!

fashionqueen0123 · Yesterday 19:52

Avacadosprinkles · Yesterday 19:02

It is on me to make sure it's resolved before the new owners move in. I'm not willing to pass the problem on to the new owners of the house. I want to resolve this first

This is now sounding like you don’t actually want to do anything about this.

No one would seriously wait for that. Or maybe you aren’t bothered about moving house. Which we all know takes ages.

But then again you’ve let someone do this to you for 10 years so maybe this is normal to you.
