Can anyone advise on what to do?
Cyclist was at fault.
Accident happened in Ireland.

They would need to check their insurance to find out.

Well you didn't mention the police, hence why I did.

Very unlikely that car insurance would cover an incident on a bicycle - why would it? Even more unlikely that house insurance would. But the cyclist would need to check their policies in the unlikely event that personal liability is covered.

If the cyclist caused the damages then yes they could potentially be liable. Totally dependent on the circumstances however - both in terms of their liability and the potential costs. No one can tell you more without details of the incident.

cyclist would be personally liable even with insurance. Home or car insurance unlikely to cover unless its clearly written into the policy.

Well then you need to let the investigation take its course and let the cyclist worry about their own liability - are you asking because you are planning on suing? In which case specific legal advice would be of more use to you than giving random scraps of information on here.

Yes, legal advice a good idea. Not thinking of suing. Worried about the financial implications. The cyclist is a relative.

Who are you in this, obviously the cyclist will need a solicitor as its been referred to the police. They will decide what action will be taken.

The cyclist will be the only one that can answer this question:

  • house insurance might cover it
  • they might have taken some other bike insurance that covers it
  • otherwise they would pay out of pocket, including court costs, if they refused to pay up until the pedestrian has taken them to court.

Can you just tell us what happened. Was the pedestrian injured. Was it reported to the police, did they need medical attention. The cyclist should not offer an out of court settlement, how could they assess the harm and damages.

In the UK the person might have personal liability cover under their household contents policy.
This was years ago but my teen dc caused an accident as a cyclist and it was covered by our household policy.
It's not a compulsory insurance though.

Just checked my current Direct Line policy, and it is still covered but not on a basic policy.
Suggest the relative reads their policy. It might not be covered in the Republic of Ireland as personal injury damages tend to be much higher than UK.

I have my bike insured against theft and the policy includes cover if I am the cause of an accident. I think it is up to £1 million.
