Parking Fine - I did not exceed the limit

Hi, just wondering if anybody is able to shed some light on why I have been issued a fine please.
In October (not the day the clocks went back) I went to KFC drive through, it was busy, however I was in and out of the drive through within 24 minutes. I didn't park up or anything.
A few weeks later I received a civil enforcement from a parking company saying I outstayed the 60 minute free parking, when I didn't?
The proof they sent me states my 24 minute duration - And the timing was between 23.55 - 00.19am - so is it because it crossed over into midnight?
I have appealed stating this as my reason however my appeal has been rejected based on the reason of outstaying the 60 minute time limit?
KFC have said they can't help with it and have said I have to go through the parking agent. I can now still pay the £60 which was the initial payment but I don't feel I should have to as I didn't do anything wrong?

There are some brilliant folk there who know the ins and outs of this extremely well. it is highly likely that in addition to the case itself, the parking company's letter will have procedural errors, well worth checking out. You will get good advice and guidance there.

Some of these are annoying to fight as it takes time and effort. But the more people who roll over and pay up when they don't need to, and haven't made any infringement anyway, the more incentive there is for some of the more rogue companies to pursue speculative charges in the first place... much better if we all fight back where we can. @ParkingLarking . This one doesn’t need time and effort to fight though. The invoice is blatantly wrong and unenforceable. The OP is making a meal out of this with appeals etc, when all she needs to do is ignore it.

I have submitted my appeal via POPLA. What a complete waste of an hour that was.
I will update once I get a response, I am not expecting it to be fast, as it said it can take up to 21 days for the company to provide their evidence.
Their evidence of me being 24 minutes!
Rediculous

Yes it's all done and dusted as far as I'm concerned. I'll be very surprised if it gets rejected a second time.

Yes I'm not expecting it to go to court.
Im expecting my second appeal to be successful!
But if it isn't then I'll go as far as they want to take it!

Not feeling stressed anymore as I've done the second appeal now so I don't have anything else to do.
I've read each appeal costs them £30 to refer to POPLA, so they must think they are still being legit!

Only thing I can think of is that it must be because it crossed over into midnight, so it's their system that picks it up as 24 hours.
But even still the sign I shared in here stipulates 09.30-03.00 hrs daily so even the midnight thing doesn't apply according to their rules. .

There's a huge move to these companies using AI for the whole enforcement process. The midnight thing is exactly the kind of thing AI would miss, and the claim may well go ahead regardless until a human gets hold of it which might not even be until court day! It's all about churn and pressure tactics.

My friend got taken to court by the same company. They even sent a barrister. My friend won, luckily, but it wasn't a pleasant experience. Thankfully a judge will take one look at yours and throw it out. Just be prepared for it to have to get that far Sad

Thank you for this. What terms did they say she was In breach of and what made it un pleasant? I mean I know it's not pleasant but did they do anything in particular to cause distress?
I'm under the assumption POPLA is ran by humans, and around half of cases get dismissed according to recent stats.

Well done for sticking to your guns, OP. I’m sure they cancelled it because they realised that if it came to court, not only would they lose but also they’d be made to look extremely stupid.

Sound like it’s finally been reviewed by a human rather than AI, before it went to POPLA.

Do they sell your data?
As yes they have my reg, full name and address all for nothing.
