Cowboy builder threatening to sue me for being honest about his shoddy work

Hi, I wonder if anyone could help or advise - The builder that did work on our bathroom and kitchen wrecked our house!!! He broke our bath, broke our shower tray, cut the shower doors too high and didn’t seal the shower causing the shower to leak everywhere. He levelled the bathroom floor completely wrong and uneven and cut the bath panel wrongly. The tiles we bought were very expensive and he wrecked about 60% of them by cutting them with the wrong equipment. The electric work he did for us was so shoddy and dangerous - The list is endless. Breaking the bath was the last straw (goodness knows how he did it!) but we said we wasn’t happy with his work and he picked up his tools and just left with the job unfinished. He then emailed us an invoice and we said we would only pay for the actual work he did minus breakages. We agreed upon a figure and paid him upon advice from citizens advice.
We have had numerous huge leaks from the bathroom since he did the work and these leaks have been because of the work he did - the latest leak was a few weeks ago and because of this latest leak we now have to have our bathroom and kitchen and also the kitchen ceiling completely re-done (again!) and will cost us thousands of pounds.
A few days ago on social media on a local group there was somebody asking for recommendations for a bathroom fitter. His family member recommended his company and gave a glowing reference (??!!) I commented saying that I absolutely could not recommend this company because they wrecked my house and cost us thousands in repairs. A few hours later the builder guy messaged in a very threatening manner saying that what I said was slander and if I didn’t remove my comments he would speak to a solicitor to sue me. I probably shouldn’t have done but I messaged back saying that what I commented was not slander as it was all completely true and I asked him not to threaten me. He said it was slander as the company that did my work no longer exists as he closed it down and the new company (that his sister recommended on social media) was a different company with a different name and company house - (the new company has a very, very slightly different name) It is basically the same company with him as the sole worker but he closed down the first company I think because of the many bad reviews left on the website (none of which was me)
Anyway….if you are still reading (and thank you for your patience!) My question is - Is this true what he said? Is this slander? And can I get into trouble because of it? I wouldn’t have said anything negative (although true!) if I knew he was now under a different company name but the change in company name was so slight I didn’t notice - it was still him that did our work regardless of the change of name of the company and he was still responsible for thousands of pounds worth of damage.

I would amend the review to name him and not the company 😂. He's awful.

Edit your review to clarify that you are referring to his previous company, and that you understand he has now set up another company (do not name it). However I think you can probably safely name the individual who did the work in your house.

I suppose you could amend your post with the name of the old company pointing out that the new company has the same owner and it appears he has started a brand new company with a very similar name.

Did you seek legal and insyrance advice when he wrecked the house, have you got hotos of his work, reports and repair bills from the people who fixed everything.

Yes you could amend your review saying the builder had threatened you as technically you were wrong given he’d changed the name of the company. Make sure you screenshot the threats too, in case he deletes them.

I think her has been to my house ,I named him ,told the world the facts of what he had done to my house ,and he has gone very quiet ,what an he say I have photographed everything

The guy is clearly incompetent and shouldn’t be continuing doing this work - how is it fair on the poor, unsuspecting clients hiring him, not knowing the recommendation is from a family member and that he’s changed his business name to hide the previous terrible reviews? Would YOU be happy to lose thousands of pounds because someone decided not to warn you when you posted on social media asking for recommendations? I know I wouldn’t. I bet he doesn’t have appropriate insurance either.

OP I agree about clarifying the name of the man that did the work as being who you are revering to and saying previously trading as the old company name. People can see for themselves then that the company name is deceptively similar.

I can’t see him actually risking taking you to court - he’s trying to bully you into taking down your comments. If he did, whilst I’m not a lawyer, I’m struggling to see how he would win given you are telling the truth and he’s the one who’s caused the damage then tried to hide from it. I don’t think judges are too keen on shody businessmen trying to con people!

He won't sue, it's all bluster. Presumably you've got photos of his bodged work and an email/text trail between you that confirms he broke stuff and you only paid for the work he did? If so, add an edit to your review saying "Joe Builder has since asked me to point out that he no longer works for xx company and has set up a new one under the name xx. I am happy to show examples of his work to anyone who wants to see it" then leave it at that.

Firstly its not slander but libel. Slander is he spoken word and libel is the written word. Your review was written.

Taking someone to court for libel is extremely expensive. You have to be able to prove😣
#1 that the claims are untrue
#2 that they were done for malicious reasons
#3 that you have lost business or reputation as a result.

Assuming you have photos, invoices and other documents to prove the shoddy workmanship and the costs you have incurred to call in another company to remedy the faults then you can prove your claim.

You can argue that you posted your review in the public interest to warn others and not out of malice. Especially as there was some deciet involved in the man being recommended by a family member posing as though she was a satisfied customer.

It would be very difficult for the tradesman to prove that he had lost business or reputation, particularly as he has now closed down that company.

I would go ahead and repost the review on every revue website, including the fact that he had threatened and bullied you. Then block off all communication.

You probably have grounds to go to the small claims court to sue him as an individual for the cost of the damage but his craftily changing the company name might make that difficult. But then I am a vengeful bitch.

" Mr Pipes has been in contact to let me know that this is a brand new company. QMy review refers to Better Bathrooms (in which Mr Pipes was the only plumber) not the brand new company Best Bathrooms (in which Mr Pipes is also the only plumber). Hopefully the new name has improved his skills."

He really is! What hurts most is that we welcomed him in to our home whilst he did the work - I even cooked for him!

We did think about seeking legal advice at the time he did the work but decided against it as we thought it would be too stressful - this is a decision I regret now. We have absolutely loads of photos as proof of his incompetence plus lots of emails and a letter of complaint to him which he acknowledged and replied to - thank you for your reply

You might want to add that winding up a ltd company and starting a new one with all the same directors is the oldest trick in the book.

Thank you so much for a wonderful reply - it has really helped! I have seen his sister recommend him on Facebook a few times and before I held my tongue as I didn’t want cause any bad feelings but this time it was an elderly disabled woman asking for a recommendation and my conscience just wouldn’t allow it. I agree that people should be able to warn others of rogue traders as it is really awful when it does happen
