Can anyone help with car warranty issue?

I bought a secondhand car two years ago and I have had it serviced with the dealer twice. I reported a fault to them, it was losing oil quickly, under warranty and they asked me to track the mileage before I had to fill up again which I did. The car is now out of warranty and the dealership has identified the problem and says it is burning oil and needs a new engine.

Now here is the problem, the previous owner had it serviced twice at a local garage and not with the dealer. I have the invoices for those services but I cannot find the service logbook anywhere. I now don’t know if I’ve lost it or if I was never given it - I just can’t remember. The dealer is saying the logbook with service stamps is needed for the repair to be covered under warranty, is there anything I can do? I can prove the services happened at the correct time so this feels like a way for them to get out of fixing a known issue with this make and model.

If anyone can offer any advice that would be very much appreciated.

In case it isn’t clear, as I reported the issue during the warranty period it should be covered by the warranty. But it is the lack of logbook and stamps which is apparently the issue.

In theory the invoices should be sufficient, as long as you can prove it was serviced by a VAT registered garage, according to the manufacturer’s schedule using OE equivalent parts.

I can prove it with the invoices but the dealership is still asking for the logbook which I just can’t find. Perhaps I should try Kia directly.

Was the car purchased from a Kia approved dealer or an independent ?

It was originally purchased from the Kia dealer who is now requesting the service book. The previous owner to me had two services at an independent garage, with all items itemised, and when I bought it I continued at Kia. Now this 😔

Did you buy it from a Kia dealership? If you did when you bought the car the dealership should have ensured the terms of the warranty were met re previous services. If you didn't buy from Kia there's a strong change the manufacturers warranty was no longer valid as they generally require servicing by a main dealer to maintain the warranty. Depending on the above it's possible you were miss sold the car.

Just to be clear, I bought it from a private individual who bought it from Kia. The previous owner to me had two services at an independent garage (which I have detailed invoices for) and I have since had two services with Kia. I reported the fault under warranty but it is now out of warranty.

That isn’t what the dealership is saying, they said the fix would be covered by warranty but that they need none Kia service invoices (which I’ve provided) and the service logbook with stamps (which I can’t find anywhere).

The issue is a known and well documented problem with my make model and age of vehicle, it hasn’t been caused by a lack of service logbook it seems to be a manufacturing problem.

I will escalate to Kia themselves if needs be but I’d just like to figure out where I stand first. I’m glad you got there in the end with yours.

It’s my first time ever with a car that has any kind of warranty so it’s a shame it’s not straightforward to use it.

Oh god. It really felt like the man at the garage was working through a list of get out clauses in the hope that they wouldn’t have to fix it when the problem was diagnosed.

I work for a car brand
I would contact Kia directly and explain, you've got proof of the services/dates etc so there shouldn't be a reason they need the log book as well, people lose them all the time which is why a lot of cars have online service history now!
If it's a known fault they're probably doing it under a goodwill gesture
Servicing can be done at any VAT registered garage and as long as they use the correct parts and fluids it doesn't affect a warranty

Well I reported it in October and they told me to keep driving it until it ran out of oil again, which I did, and then to bring it in. So that would prove that I guess.

Not at all, as long as it’s serviced on time by a VAT reg garage using quality parts.

The warranty only transfers if you buy from a Kia dealership. If you bought from a private individual the warranty will have ceased at that point.

That hasn’t been the case since at least 2010. The warranty transfers to subsequent owners even if sold privately.

@ThisIsClearlyMe I think you were given inaccurate information, did a dealer tell you that you had to purchase from a dealer to take the warrantee balance? If so you've been miss sold.
