Job offer possible withdrawal

I interviewed for a job, was offered the job the same day and accepted. I have now completed references, obtained uniform and have an occupational health appointment next week. I was very transparent about my qualifications throughout the application and interview. I have provided my certificates and ID to the recruitment team who stated they had everything they needed (this is an internal move).

The application stated NVQ3 or equivalent. I have alevels which I was led to believe was equivalent, as was the recruiting manager who has stated via email that this has always been the case previously.

HR have now decided that alevels are not equivalent to NVQ3 as there is no practical element. They have now retrospectively applied this new rule to my application and there is a good chance the offer will be withdrawn.

I am devastated and feel this is highly unfair. I understand they need to draw a line however I feel this should be for future advertised jobs and should not be retrospectively applied.

Is there anything I can do? I'm going to ask for a meeting with HR tomorrow.

Well that's shit. Wasn't the job supposed to have started by now? If you were able to take legal action at some point you could potentially sue for loss of earnings!

Yep it was. I still had to go to an occupational health appointment for the role today! It's bonkers!

No update I'm afraid. It had gone higher and I'm fighting this but there has been no movement for the last week.

Some very kind colleagues have given me bank work to cover me for the foreseeable but I'm majorly pissed off.

Nah, having A Levels in theatre studies, english and geography are in no way literally the equivalent to an NVQ3 is food production say, so obviously it would be like for like.

Is the job practical?

I think you are in a strong position as it said "or equivalent ". Keep escalating if necessary and pull in the union.

My understanding is the recruiting manager can overrule HR if they really want to. It happened to me for a job I started last week. HR were being ridiculous about references, asking for the impossible, and my recruiting manager just said enough, and I got an unconditional offer and a start date later that day!

@1ittlegreen whilst in theory I agree... the advert did not specify and I was open about my qualifications and the hiring manager was/is also happy.

@AnneValentine it's still available. It has not gone out to advert yet. However I don't want to go back for various reasons.

I have options. I need full time. My old job is not and doesn't have the option to be.

Very sure. I passed the reference stage with no issues. This has been confirmed by HR. I'm not great at many things but I am damn good at my job.

Plus if that were the case surely that would be the end of the matter? They wouldn't be taking it further or higher.

Gosh this sounds so incredibly frustrating OP. I really hope that they can get this resolved. In my organisation someone (hiring manager or their boss or boss' boss) would have the power to make a decision on this, they couldn't just be overruled by HR.

I’d make the point you were transparent and the employment checks haven’t shown anything you haven’t declared. They had all the facts they have now when they made the offer so you believe you have a contract and if they don’t honour it you will go to ACAS.

So? They can just give her notice anyway. Usually this is a week in probation so not much use to the OP
