Son had an accident

Hi. Looking for advice please. My 15 year old son was at football training 4 weeks ago and broke his leg . Open fractures in 2 places. Then he developed compartment syndrome the day after they fixed the bones with plates, rods and screws . 3 operations later and still in hospital. I was asked if I am putting a personal injury claim for him. I didn't even know I could do this? Family are telling me not too. But others are saying I should. I am going to ask for advice from solicitors but it's a life changing injury he's been through and his leg is a mess I am thinking it would be a big help for him when he turns 18. Anyone else think I should go ahead?

I'm not sure about football but sport I do has injury insurance built into the governing bodies registration so you claim against that not the club. Could football have something similar?

Some of you should be ashamed of yourselves. Where's your compassion? OP is scared and has misunderstood, originally posting in the wrong section. Not a huge issue is it and certainly no need to be so rude. I'm sure none of you are perfect... I can outright see you're not.

I'm sorry that you and your son are going through this. I hope he has a speedy recovery.

Speak to a legal professional. It may be that there's a claim you don't see, such as ground not maintained to a relevant level, or there may be absolutely nothing. It may be a simple insurance claim but you're right to get the best help for your son as aftercare on NHS can be poor.

Op stick in a claim nothing to lose. Go to a no win no fee solicitor (just check the % they take of any settlement - look on trust pilot for recommendations for sports injury personal
Injury solicitors) Insurance will assess claim and you may come out with nothing you may come out with something - even payment towards future treatment. With a try.

Who would you be claiming against? Was anyone at fault?

The point is that on the information given, we don't know if it was an accident, or due to negligence, or due to something like a deliberate foul. OP, you only have a claim if there is some indication that the accident was caused by negligence, recklessly, or deliberately. You haven't said how the accident happened so no-one here can really advise you.

I think it's worth seeking professional advice.

A little bit different but I was in a car accident years ago and had a hairline fracture in a vertebra that caused me some ongoing issues. The insurance commission paid for my treatments, but after a year tried to stop. I sought advice and ended up getting a small lump sum payout from the insurance commission, in order to fund any future treatments needed. It wasn't the insurance commissions fault that someone crashed into me, but the purpose of insurance is to provide financial aid in the event of an event like this.

It sounds like the impacts of your sons injury will be significant and possibly life long and through no fault of his own. I'm my mind, that is exactly the sort of thing sports clubs have insurance for.

You need to ask the club what insurance is in place if any. You might have some info when you paid the subs? I doubt you would get much but you could enquire.

They break legs all the time in football. Providing they didn't say " dont wear your shin pads" I fail to see how they were neglectful.
The club may have insurance but again against what? An accident?

This must have been a big shock for you and your son and I hope he gets the help to get the best possible recovery outcome.

Talk to the coach about the teams personal accident insurance, it's mandatory for any FA Affiliated team.

Whereabouts in the country are you OP?

In Manchester we have access to the Manchester institute for performance for some major trauma patients, same place some Manchester City players go...

Most major trauma centres have access to mtsp (major trauma signposting) who can help with things like claiming enhanced benefits or advance payouts for Rehab.

You're best to contact Irwin Mitchell or an appropriate solicitor that deals with this. They will go through an assessment to see if this is something that compensation could be awarded for or not. There's no harm in seeing what your options are, you don't have to go ahead with anything. BTW, I'm absolutely not someone who is claim-happy, but when someone suffers a serious injury then I do think it's something that should be considered.

This. Based on the fact he has life-changing injuries, it would probably be remiss of you as a parent not to explore the possibilities. If you’ve got no case, then at least you’ve confirmed that. The type of care he might need could be expensive and lifelong, and could also have an impact to his career potential. From what you’re saying, it’s possible prosthetics may be required or changes to his living accommodation. These are not areas where you want to rely on the NHS providing the best options. I think Irwin Mitchell are a good place to start. They will tell you whether you have a case or not, not posters on mumsnet trying to guilt trip you.

This isn’t about being nice or trying to figure out yourself whether it was an accident or not. This is something that should be looked at with a clear and practical head.

Possibly, yes. You know, like the insurance you get for car… accidents. I doubt either you or I are the experts on this though. And this sounds like a very serious situation. Where experts should advise. Hence why people are advising the OP to seek that.

His team will have insurance. Of course you can claim for an accident. Car crashes are accidents; you can still claim.

Compartment syndrome is a major problem with muscle and skin loss. Poor chap 💐

Compartment syndrome will have implications for future work opportunities and affect his ability to do particular types of work. Many professions/ vocations expect a certain standard of fitness

I presume the OP didn’t know what ‘life limiting’ really means when she posted on this board, and assumed it meant potentially limiting what he can do in the future, not that it is a condition which will kill someone prematurely.
