Son had an accident

Hi. Looking for advice please. My 15 year old son was at football training 4 weeks ago and broke his leg . Open fractures in 2 places. Then he developed compartment syndrome the day after they fixed the bones with plates, rods and screws . 3 operations later and still in hospital. I was asked if I am putting a personal injury claim for him. I didn't even know I could do this? Family are telling me not too. But others are saying I should. I am going to ask for advice from solicitors but it's a life changing injury he's been through and his leg is a mess I am thinking it would be a big help for him when he turns 18. Anyone else think I should go ahead?

Who would you be suing? It's very unfortunate, but claiming against the team seems wrong if it was an accident as you said. Accidents happen.

Yeah, I think you'd be able to claim against their insurance. It's a life CHANGING injury, for sure. It's not a simple broken leg like some here are saying. What about your household insurance, too? It's going to take a lot of long-term rehab and have lifelong consequences.

Oh OP I didn't mean to criticise you for misuse of the term 'lifelimiting' I was commenting on another comment. The thing about moving it to Legal is just a practical MN matter, things get moved quite a lot.

I think OP understands the difference between life-limiting and life-changing now. No idea why people feel the need to pile on about this.

What a devastating thing to happen to your son op. I would imagine the club should have insurance against which you might be able to make a claim. Definitely worth pursuing for your son's sake.

Do you have personal accident insurance? If so, go for it. You can make a claim for permanent disability as we call It.

did he not have insurance? normally teams or individual players have insurance in these situations.... I remember paying for insurance when I was heavily involved in tarkwondo....

You can only claim against a company or individual if they have been negligent - and their negligence caused the injury.

I would seek advice from a solicitor. You'd be mad not to claim if at all possible. The NHS is shite and he may well benefit from private healthcare further down the line. This is what insurance is for.

Doesn't hurt to speak to a solicitor to see what your options are? There would be no obligation if you chose not to pursue it and if it is life-changing, it could make your son's life a lot easier to have financial help, if successful.

There's no rush- he has 3 years from the time he turns 18 to bring a claim if the accident was due to negligence

How did the incident/ accident actually happen? Was he tackled illegally, trodden on deliberately, or was it an unavoidable accident.

I know OP's son's issue isn't life-limiting as we're using it here, but as an aside, life-limiting needn't always mean terminal. My bestie has lived with chronic kidney disease for thirty years.

I doubt it can be moved at this time of night, MN moderation is not 24 hours. Presumably you've reported it and it will be moved in the morning.

In the meantime though, this is a mother sitting by her son's hospital bed wondering if he's about to lose his leg. Yes, some people on this board are currently facing worse but that doesn't mean OP isn't deserving of some compassion rather than a race to the bottom.

I'm so sorry about your son. That must be devastating for him and you.

If insurance exists and if he is eligible, then he should claim but I wouldn't get too involved at the moment because if he's not eligible, he might be upset about that.

In Ireland that vast majority of school students , primary and secondary, have a personal accident insurance which they pay I think it's 11e for and covers them annually 24/7. Do you perhaps have some personal insurance like this? Devastating for sure for your son. Glad topic has been moved..

Yes, you still discuss this with a solicitor and definitely consider making a claim.
