Son needs an operation following camp, is there negligence

My son went on an organised camp with a well known youth organisation. He fell playing a game and has dislocated his shoulder. It has since dislocated again and the consultant says he now needs an operation to strengthen the joint and hopefully stop it dislocating in the future.

Mil has suggested we look into a personal injury claim but I'm not sure there is any negligence on the part of the camp, it was an accident. She's raised the point that it could cause problems in different areas of his life etc

Has anyone any experience of something similar or know if it would be classed as negligence? Surely accidents are just accidents sometimes?

Schools do have insurance which covers this sort of scenario. My daughter’s friend fell over at school and knocked a tooth out. It was an accident and the insurance paid out for her expensive dental treatment.

@kirkirinm that is a policy offered. It does not mean it has been taken out.
I have received permission slips from organisations where I can pay an additional fee for personal medical insurance.

I can see private schools may have this insurance.

All state schools in my LA have public liability insurance. It’s not a legal requirement but it’s regarded as an essential cost by the council. Everything has insurance public parks, toilets, council buildings, libraries etc.

Yeah I'm not suggesting it has been taken out. I suspect unless it's an organised group where you pay a membership fee (so you're covered by any such insurance) that the camp will have PL insurance.

But the OP has been very vague about what type of camp it was.

Yes, there is insurance! I wish they had volunteered the info without having to ask for it. It would have saved a lot of stress. I'm waiting for the documents and finer details.

I suspect if you claim the price goes up next year so they don't tend to volunteer it. Good luck with it all, I know when DS had a nasty accident it cost us quite a lot depite the NHS. Time off for recovery/ appointments, physio etc. The idea of insurance is that it puts you back in the position you would of been in had the accident not happened.
