Neighbours new gate drilled into my wall

We bought a property in 2018 which is detached. Our neighbours had a gate down the passage which was attached to our wall. They removed this gate when they had building works done. Two days ago they erected a new gate in a new part of the passage. They own the passage but we own the wall. Therefore the new gate is not in the same place as the old gate. Whilst I have no issue with them having a new gate I have an issue that it’s in a new place, that they didn’t tell us they would be drilling new holes into our wall (the screws are into the mortar if that makes a difference) and that I do not know if they have filled the previous holes. Where do I stand legally? We have taken photos and spoken to the neighbour. They said they didn’t think it would be an issue as they are just replacing a gate which was already there. But in my opinion it is not a like for like swap as new holes have been made.

I do not want a neighbour dispute as we are planning works to our house in the next few years which we would need access onto his property, otherwise it’ll be more difficult.

My issue is that near where they have drilled we already have holes and surely the extra holes add extra weak points to the wall where it can crack?

Please ask if there is any other information which might help. The resolution we want is insurance details from the company with a letter from them to confirm if any damage happens to our wall which is proved to be the result of this new gate that they would cover it. Is that reasonable?

No - unless you can see damage which considering its just a gate is unlikely why would you start an issue that could cause problems for both of you if you wish to sell?

So they replaced one gate with another but the holes don't correspond? Ask them to fill it in. Not worth fuss.

You are honestly creating drama for no reason. You will need your neighbours co operation when your own work starts so please don't cause a fuss over this.

That's a big deal about a little problem. Fill the holes in and think about what would happen if they denied the builders access to their property. when you're having your work done, which is probably what will happen if you keep on making a fuss and fall out with them.

If you need access to their property for future works, I probably wouldn't make a fuss out of this OP.

It seems like a total non issue IMO and definitely no need for insurance.

This is the sort of thing that would be pinned up to the insurance company wall as an example of the daft things people ask for.

I think we need a picture. A 'new gate' could be anything from a couple of wooden slats to a custom-made hefty iron gate.

If you are planning works then pissing these neighbours off about the gate could make them less likely to be okay about your works in the future.

I'd honestly just it go. It's not a big deal. A couple of holes in your wall is not going to make your house fall down!

Totally crazy. A gate attached to a wall does not cause structural issues.

Reasonable is politely asking the neighbour if they would arrange to have the old walls filled. Asking for insurance details etc is pure bonkers.

You're in danger of both alienating your neighbours and becoming know as the mad/unreasonable people of the street if you continue with this course of action!
