Job Offer withdrawn after informing employer that I am pregnant.

Hi all,

I originally posted this on as a pregnancy thread. As the situation has evolved I have been advised to post on here. I was offered a job yesterday afternoon and although I know I was under no obligation to inform them, I told the employer that I was expecting in December. Since then I have had the job offer withdrawn as they felt that I “misled them” and wasn’t honest. Is anyone able to give me some advice if I were to take this further.

Hey all, I have just received an email from the respondent asking for the tribunal case to be postponed as she is an at risk and has to self isolate for 12 weeks. With the hearing being on the 6th of May she would not be able to make it. Where do I stand with this? Do I have to agree to postpone or can I ask for it to still go ahead? does anyone have any professional advice before I reply to the employment tribunal?

I’d like to add that obviously I am sympathetic towards her if she is at at risk as I have three in my own household and we have all been self isolating for the last 2 weeks! just wanted to know where I stand, If we postpone we might not get another hearing date for a long time.

What will happen on 6th May is a case management hearing by telephone or similar to discuss how best to proceed. She may not have realised that she will not be expected to go to the tribunal hearing centre - nor will you or anyone else involved in the case.

You don't have to agree to her request. However, the tribunal may agree to postpone things if her health at the time isn't good enough.

I would've thought it would be postponed anyway tbh.
I cant see them doing tribunal hearings with all the social distancing rules and maximum 2 people per gathering

I was thinking the other day that it was only a matter of time until I heard something tbh.

You don't need to ask for a video call. As per my earlier post, all hearings are now by telephone or video call.

The OP doesn't get to decide how it will be arranged and doesn't need to see written confirmation from the NHS. It WILL be a telephone or video call.

@prh47bridge - They have emailed and asked me for my response on the postponement. They haven’t said we can do this by telephone or video call they’ve asked for me to respond.

Why not reply saying that under the circumstances you're happy for it to proceed as planned using video conferencing

I responded via email saying this:

I completely understand under the circumstances the reasonings as to not want to/be able to meet in person. However, I was wondering whether the hearing would be able to be conducted via telephone or video call.
I would prefer for it not to be postponed as this has caused me a lot of stress and upset already however if there is no other alternative then I will agree.

The respondent has just emailed back saying this:
I appreciate Ms ...’s swift response.

This is a very stressful time for all of us.

I would be extremely unhappy to conduct the hearing by telephone or video call.

I believe this would give an unfair representation for both parties.

I appreciate Ms ... saying that she will agree if there is no alternative.

As it will be by telephone or video the fact she is self isolating does not prevent her from taking part.

As per my last post, neither of you has any choice. The hearing will be by telephone or video call. There are no in-person hearings at the moment. However, it will be a case management hearing to determine how to proceed rather than a hearing to decide your case. It may be that the tribunal will decide to conduct the entire case by telephone/video call or it may be that they will decide it needs to wait until the hearing can be conducted face to face in the normal way.

@Mummytoonlychild Hey! No absolutely no response whatsoever, the last email that was sent was by me simply saying that I would like to go ahead with the video call/phone call and referred to the website! Haven’t heard anything from the respondent or the employment tribunal!
