Job Offer withdrawn after informing employer that I am pregnant.

Hi all,

I originally posted this on as a pregnancy thread. As the situation has evolved I have been advised to post on here. I was offered a job yesterday afternoon and although I know I was under no obligation to inform them, I told the employer that I was expecting in December. Since then I have had the job offer withdrawn as they felt that I “misled them” and wasn’t honest. Is anyone able to give me some advice if I were to take this further.

There's a fab book by Naomi Cunningham that helps you self-represent at ETs. Employment Tribunal Claims: Tactics and Precedents https://www.amazon.co.uk/dp/1908407352/ref=cmswwrcppapiii_SUYHDbBK6MVY4

I used it for mine (I lost but the judge tore my ex-employers off a strip for their attempts to claim expenses) and it was fab. If you'd like it I'm happy to send it to you - pm me your address and I'll pop it in the post tomorrow.

jelly79 · 22/09/2019 22:14

Keep checking in on the updates ... I have spoke to a few HR friends and we are all routing for you OP! Try to take each day in your stride though x

Newschapter · 24/09/2019 13:56

Keep going!

You're taking a stand that whilst it may not help you (jobwise) it will certainly help other women!

Good on you!!

I've only just stumbled across your thread and wanted to say good luck with this! Pregnancy is hard enough without having to put up with this sort of attitude.

I would definitely recommend that you are legally represented at your tribunal. There are lots of barristers who are registered for direct public access if you need to keep costs a bit lower. But I would not suggest that you represent yourself, especially not at that stage of pregnancy or within a tiny baby!
If you instruct a solicitor and barrister or just a barrister then it'll run more smoothly and they will ensure that you're not at a disadvantage because I can guarantee the company will have representation!

Keep us all posted on the outcome!

Good luck OP do keep us posted, we’re rooting for you.

GoodBoyGhost · 08/10/2019 22:41

I hope everything is going ok OP! I'm still stunned at the unprofessional behaviour of the company. They so obviously discriminated against you and are now trying to back track. It's pathetic!

Northernsoullover · 08/10/2019 23:12

I hope it all goes in your favour. I remember reading this thread when you first posted. I'm so proud of you for challenging them.

Bofster37 · 19/10/2019 19:11

How’s it going @Char1997? Any more progress?

Char1997 · 19/10/2019 23:11

@Bofster37 hey, I received a confirmation of correspondence from the employment tribunal courts on Wednesday just asking me to confirm some details, believe after this the company has 28 days to seek legal advise and respond to which they can still settle.

9 weeks 2 days till my due date some fingers crossed it doesn’t run on too long😫

Glad it's still moving forward.

MiniMum97 · 20/10/2019 00:55

Good luck OP! I do hope you are successful. The employer has blatantly discriminated. Keep us informed with how it goes! 🤞🏻🤞🏻🤞🏻

JollyHolly30 · 20/10/2019 12:06

Fingers crossed for you! It might all happen just before your due date at this rate but I see no reason for you not to win with the evidence those emails contain!

Tohavefarted · 24/10/2019 22:39

Looking forward to an update

username2020 · 01/11/2019 09:28

Adding this to my watchlist as I'm about to start the tribunal process myself for disability discrimination. I've done a shitload of reading up on employment law too. Wishing you luck with your case OP and your pregnancy.

Char1997 · 01/11/2019 10:06

@username2020 oh best of luck!! I will 100% update this thread as and when I hear anything!
