Small Claims Court

So, we have had a terrible experience with a kitchen company and, despite trying our best to sort it out, have been ignored, so I am intending to take them to the small claims court. I have sent three letters, the final being the pre- claim letter to their registered address, and they have all been returned today as 'refused'.
I know this is their address and am even more determined to continue. What should I do next? I thought I should maybe resend all three registered post, then just put the claim in??
Any help is most welcome as I am not the only one who has treated like this by this company. Luckily we had a bit of money (inheritance) behind to be able to put it right, but I've had contact from people who have been left in a terrible state. I am furious!!

That sounds stressful OP. Just bumping this for you.

Send two copies of the letter (NOT signed for) from different post offices, and get proof of postage from both.

These will stand up in court as delivered. This is a good technique to use as parties often refuse signed for documents.

Thank you! That is a good plan. The date for starting action form the last letter I sent is tomorrow so unsure if I should start the process anyway?

Yes - start the process anyway. They have already refused the letters so sending them again will unlikely change anything, but 19lottie82's suggestion is very sensible for proving to the Court you have tried to contact them.

I'm on it!!

Hope it goes well for you @Lepetitpiggy

I used the small claims process a few years back. Two things Hd were particularly helpful: I could fill out the form and save it while thinking what I wanted to do. The other was that you can charge interest from the date you think the debt is due, so it the faster they pay up the cheaper it is for them which was a powerful incentive.

I sent the supplier a print of the saved form to warn them I was about to start proceedings and they paid up like lambs, having claimed for weeks that they could not afford to pay. Humpf

We own a scaffolding company and lots of times builders don't pay us. We take them to the SCC about once a month! Its a very easy online process and I recommend doing it immediately.

This is the link for it: SCC Charge interest as well.

If you send me a private message with their name/address I can look at their Credit Rating using the tool we have with our business and let you know privately if they are in a load of debt, have CCJs already etc.

Thanks everyone. I have already done the form - wanted to send it weeks ago but felt I should go through the proper channels, thinking they would play ball! haha.
I have since found out that the address is a serviced place so clearly they have moved on - as they do, probably will change name again soon...
BigusBumus, I will send you their name
