Hi all. Everyone keeps telling me to post on legal, so here I am! I don't want to take it to court or anything but I think I could do with knowing my rights a bit, as I'm feeling a bit out of my depth.

But they can continue the investigation in the OP's absence, and pass on their findings to the relevant regulatory body.

I can understand wanting it over and done with, but because it is a regulated profession the reality is that this could take some time.

I know, that's why I asked if it was regulated. And, as it is, they may be able to compel her to take part in the investigation, it depends what it is, what the issue is, what her role was, what her contract of employment says, etc.

The investigation continuing is nothing to do with clearing the OP's name its to do with showing that procedures have been followed.

Ok so I have to carry on with it, regardless of resigning - is there anything I can do to speed it up?

I feel like a failure.

It has in some ways as it's opened up my eyes to the mess the industry is in and I've chosen to leave. It's bloody hard starting again.

The fact you have resigned before they have completed the process means you are unlikely to have a case for unfair dismissal, constructive dismissal or similar. It sounds like the process has been poor which may have given you a case but unfortunately it is too late now.

I am a little surprised the union is not representing you. Are you still a member? If you are, I would query this. It may also be worth checking your home insurance to see if that includes legal cover and, if so, whether they can help.

If you have taken more holiday than your entitlement normal practice would be to deduct the difference from your final pay.

I really would speak to an employment lawyer. They may confirm that you don’t have much of a case, but at least you will know.

An initial consultation needn’t be expensive.
