Refused alcohol in Marks & Spencer's?

My husband just got refused buying a bottle of wine in Marks & Spencer is, at the age of 38!

Whilst he took it as a compliment.. (he hasn't been Id'd in years!) we both were just wondering randomly where the law stands with this in the UK?

The law stands with M&S, just like it does in a pub - they have the right to refuse to serve anyone.

Interesting! Reason she gave was she wasn't sure if he looked under 25 or not.

All the posters say "if you're under 25, bring ID", not if you're under 40 lol.

Good to know they're incorrect and in fact you have to bring ID at all ages.

Well it's more like if you look under 25 you should expect to be asked for ID. But anyone can be asked, m&s are quite strict about asking for it I find.

If they'd challenged him and he didnt produce ID and they sold him it anyway the member of staff is culprable, not the store x

I just checked, the posters in & around the store say "UNDER 25? Please be prepared to show proof of age when buying alcohol." So at age 37 one wouldn't expect it. They don't say "LOOK UNDER 25?"

I checked on the website, it says "The new signage in red and black adds a fresh and striking look and makes it clear that under 25s must now expect to be challenged to prove their age."

.. it doesn't say under 40s must expect it 😂

I got IDed for the lottery (16) a few weeks ago. I'm 32.

If u appear to look under the age of 25 then they will ask you for id... so if your 30 odd but having a youthful looking day and they believe you could be 25 or under they will id you.
They dont know who is 25 or not obviously so its based on the checkout persons opinion of your age as they are held accountable if item is sold to a underage person.
They also dont have to sell you it if you appear to be intoxicated or believed to be purchasing it on behalf of a underage person.... im guessing ur dh was not drunk and shopping with teenagers paying in loose change for wkds... so take it as a compliment they presumed he was just a young looking dude Grin

Fragglerock, being ID'd at 42 is impressive! But was it because u look young or because it was a new & nervous cashier?

If they really say it's down to personal opinion, I can imagine people having so much fun ID'ing everyone as cashiers... including pensioners.

I was in l Morrisons last week and got ask for ID. I said "what for?" She then told me it was to prove my age. I'm 42, she gave me some nonsense that she was genuinely shocked. I think they just ask anyone without grey or bald hair and a zimmer.I look younger than 42 and have botox and fillers but I think I look 36 not 17!!

Hrmmm yes i did read the op hence the i take it he wasnt pissed so just take it as a compliment and commenting on my weird paw patrol id situation and purting a grin into the whole comment... so not sure why your getting uptight at me over it??
They can also refuse you a sale based on your attitude towards maybe rethink how you come across to people gosh talk about arsey forget i commented Wine (well not for you Grin)

I work in a petrol station and ID'd someone for cigs and she turned out to be 38. I'm only 24 and she looked younger than me.

To be honest though if we don't ask for ID and the person is younger we're at risk of loosing our jobs so better to be safe than sorry.

A lot of people get angry with us when we ask them for ID but I don't know why 🙄

But then how would they know for sure that you're over 25 unless you can produce proof?

I just turned 33 and for asked for ID in Tesco the other week for a can of Red Bull...

The problem you have is that if the cashier asks for ID and it was a slip of the tongue - they have to carry it through.

Genuine story-

My sister went through an ASDA checkout on her 40th birthday with her usual wine. She is quite cherub faced not jealous even though I’m 10 years younger and never get ID’d Angry

Cashier: have you got some ID?
Sis: *Excitedly Oh my god, did my husband call ahead and ask you to ID me for a birthday treat??
Cashier: eh.... no.... we wouldn’t do that.
