Neighbours have put cat spikes along fence - what are my rights?

Sherridale71 · 02/06/2018 06:19

My next door neighbours, two spinster sisters, have put sharp plastic spikes intermittently along the fence surrounding their back garden. The spikes are in strips of about 5cm long and they’ve placed them on either side of the concrete posts holding the fence up with big gaps in between. The fence separating our gardens is about 4m high.
I’m so angry about this that I haven’t been able to approach them to find out why they’ve done it although I’m pretty sure it’s to deter cats from going into their garden (I’ve read that they can also be a pigeon deterrent). We have two beautiful cats so I’m disgusted about this and worried that they’re going to injure themselves. We live in a neighbourhood that has many cats roaming around so they’re a danger to them as well.
My neighbours have made comments in the past about cats “crapping in the garden” and also told me last year that if they saw my new kitten in their garden they would “boot it”.
I’ve phoned citizens’ advice but they said I’d need to contact my landlady to determine who owns the border of the garden and said I’d need to speak to a solicitor as they can’t give legal advice...the internet is coming up with all sorts of confusing information.
Does anyone know what my rights are before I go and speak to them about it? My 5 year old son could easily hurt himself on them.
TIA

Just remembered last night that long-term toxoplasmosis infection does have an effect on the brain:

Think OP definitely needs to step away from the cat shit Shock and cetainly stop digging it into the veg patch Envy

It’s totally out of order. Why don’t you ask your neighbour if he’s mind hiring a scaffolding to take the spikes down. And in future just tell him to post the cat faeces through your letter box. Or offer to go round and clear it up for him every time they mess his garden up with either their sick. Faeces. Or urine killing all his wildlife or in my case my daughters play area.
As long as the spikes are rubber and act more as a deterrent and do not harm I don’t understand the problem. You chose to have an animal what Rome’s in other peoples properties. He simply does not want your animal and it’s rubbish in his garden.

OMG the poor girls living next to an irresponsible like you!! Your cats have no right to roam onto another's person's garden. If you love a child you wouldn't let then roam and get into danger so why are you letting your cats roam. Maybe it is because you don't love them enough. Children and cats can get killed by a car if unsupervised. Do the right thing and get a cage for your cats and train them to only poop on your property. In fact train them to poop in your bed so you will have a similar clean up job to the neighbours... and see how you like it you dumb stupid excuse for a person. I love cats and am passionate about animals, but I hate unsupervised cats....so grow up and walk in someone else's shoes. And while I am here, supervise your child as he has got no right to climb a shared fence and stickybeak at the neighbours!!!!

I'm sick of cat shit in my garden, I have young children and in the summer I have to check before they go out! And they seem to love ours to do their business ! Might get some of these myself!!!!

Buying some cat spikes later today, my gardens are the local latrine for all those responsible cat owners who live adjacent to me. Absolutely disgusting. I’ve tried a variety of cat repellant and deterrent products without much success., including tiger poo from the safari park. Going to give these a go.

I have been tempted to bag the cat poo and leave it on the neighbours doorstep, that’s a cleaner option than what I’ve been gifted.

It's always funny how poo of various kinds is such a hot topic on MN. Wink Pooing cats, dogs, horses who don't wear nappies, husbands who dare to use the en-suite, teenagers who don't flush, workmen and delivery drivers who should use the plentiful public toilets instead of daring to ask to use mine: these threads appear with clockwork regularity. Only on MN have I seen so much frothing at the mouth about a perfectly natural bodily function for humans and animals.

Your garden, your land. We don't get many cats in my garden. I am not sure why. There are loads of foxes and squirrels and birds so may be that deters them.

If people think it's fine for their cats to poo in a neighhbour's garden would they be happy if I came into their garden and did a poo? If not what is the difference?

My mom and dad have just returned from holiday to find their neighbour have removed the spikes off my parents fence and left the evidence by the fence on their side which my dad saw when he looked over.

So my dad (being my dad) has lifted his fence panel and retrieved his items - no trespassing involved! He plans on putting the spikes back on the fence today and having a "quiet word" with the neighbour.

Mom has her tin hat at the ready!

supermamabear · 06/02/2019 07:59

I have two beloved cats and you’re being unreasonable. If the fence is 13 ft tall (really?) mine wouldn’t bother climbing it. They’ll learn not to go over it and find somewhere else to roam.

Also don’t use the word spinster. That’s gross and unnecessary. Why do you feel the need to throw unmarried women under the bus just to make your unreasonable point?

ZOMBIE THREAD!!!

DisgruntledParent19 · 04/07/2019 17:34

I have chucked some up, it’s doing the job I wanted it to do

Neighbour have complained to the council, out taking photos few days ago.

TheOpinion · 06/10/2019 02:24

Some cat owners take the ‘right to roam’ law to mean that they cannot be held responsible for their cat’s actions whilst they are out of their boundary, but any owner should ensure they take all reasonable measures to ensure your feline does not damage anyone’s property or cause injury to a third party, as specified by the Common Law Duty of Care.
While prosecutions are rare, should your property be subjected to prolonged or persistent damage caused by a cat, you are advised to seek legal advice if speaking to the owner is to no avail.

summersherewishiwasnt · 06/10/2019 22:53

Omg get over yoursel
Other people don’t want your cat shit in their garden, how fucking dare they.
The cats are obviously an issue or your ndn woudlnt have wasted time, money and effort to deter them. You have zero, zilch, nowt to be arsey about.

I am one of those neighbours. Maybe if you’d put a litter in your garden, like a responsible cat owner that you are, then maybe they wouldn’t shit all over someone else’s garden. 🥂 to not being able to do anything about it!!!

PinkSparklyPussyCat · 22/06/2024 20:20

I'm sure it's all resolved one way or another as this thread is over 4 years old 🙄
