Parking ticket for parking in disabled bay - should I pay or appeal?

I went to a small supermarket tonight with two small kids. There were no parking spaces , just two free disabled ones. I parked in one of those spaces, went to the shop, was out in about 2 min and as I came out of I saw a guy taking pictures of the car and he put a ticket on my windscreen as I was about to drive off. Do I have any chance in appealing this? There were no parent and child spaces at that car park. Any advice greatly received. The fine is £100 reduced to £60 if paid in 14 days. Thank you

It’s irrelevant how long you were, it’s irrelevant how many non disabled spaces were available, it’s irrelevent how many children you have. The only thing that is relevant is if you have a blue badge, if you don’t and parked in a disabled bay, you pay the fine.

There’s no parking entitlements for being a parent, supermarkets do not have to give parents a parent and child space, it’s a courtesy, having children doesn’t make you get priority if spaces fought for and reserved for people with disabilities.

You should have parked in one of the many other non disabled spaces available to you rather than occupy one of the more limited spaces intended for disabled people. If all other spaces were full then you either park in a different car park , or return at a later date, a pain in the arse I know, but taking a disabled space shouldn’t have ever entered you head as an option.

If you are able bodied you can either wait for one of the dozens/hundreds of spaces across the car park to become free, which won't take more than a few minutes or you can park a few minutes walk away down the street. A disabled person has to wait for an appropriate space to become free close to the entrance and may only be able to park in the disabled spaces due to equipment and needing the extra space.

I have a blue badge. Became entitled to one after having to go through an assessment which made me realise how bad my condition had become.

When my children were small and I was fit and healthy, I always parked in a normal space if there were no P&C spaces available. Why did you not do this? Even if it meant having to park further away and walking.

Oh god the driving/waiting around looking for a disabled space. People who aren’t disabled will never ever get that!

Ah, but draggle, you’d only ever be waiting a maximum of ‘2 minutes’ for a disabled space. Because all those without blue badges who misuse them are only ever ‘2 minutes’. Grin

Everyone parks in the occasional disabled bay when there are no spaces - don't act like such a saint.

Actually, @Chatterbox93, everybody doesn't. Those spaces are designated for the disabled. In France there are often large signs up over disabled spaces asking whether the able-bodied who take the space would care to take the disability as well. It's a good question.

Its a good thing that courts take a dim view of parking in disabled spaces when not entitled and they nearly always side with the company.

So the OP should appeal so she has to pay more :)

Unless there were a queue of "blue badgers" looking for a place so they could buy their lottery ticket etc, then DO NOT PAY IT !!! Challenge it !!! I did, and I won. £60 is not a true reflection of losses made at the car park.

This is an old thread. The OP got her ticket a year ago. And I'm guessing your challenge was even longer ago. What you say does not reflect the current state of the law. The fine does not have to be a true reflection of losses made by the car park operator. In Parking Eye v Beavis in November 2015 the Supreme Court upheld the operator's right to fine Mr Beavis £85 for overstaying in a free car park.

And, bluntly, I have no time for able bodied people who park in disabled bays.
