Parking ticket for parking in disabled bay - should I pay or appeal?

Mayflower2017 · 18/01/2018 18:37

I went to a small supermarket tonight with two small kids. There were no parking spaces , just two free disabled ones. I parked in one of those spaces, went to the shop, was out in about 2 min and as I came out of I saw a guy taking pictures of the car and he put a ticket on my windscreen as I was about to drive off. Do I have any chance in appealing this? There were no parent and child spaces at that car park. Any advice greatly received. The fine is £100 reduced to £60 if paid in 14 days. Thank you

Crikey I wouldn't dare do that, even if they were the only spaces left. I'd have waited until a space came up. You have no chance of appealing that. What on earth would you say? That there were no children spaces left? That's not going to be grounds for appeal.

You’ll have to pay it. Those bays are legally designated for blue badge holders.

Mother and baby spaces are just a courtesy and legally anyone can park in them.

Are we actually expected to believe you walked into a shop with children and only spent 2 minutes Hmm.

Unless this is a massive dripfeed and your a unicorn with a missing hoof and your blue badge got stolen, then pay your fine and feel incredibly guilty that you took a space your not entitled to, cos you couldn't park in a parent and child space.

You are being very unreasonable here. i have been tempted to do the same myself at times, but then I remember that a person with genuine mobility issues could use the space more than me. I am assuming there were regular parking bays available, could you not have just a
parked there? I know it may have been a hassle with the kids, but it wouldnt exactly have been a 10 mile walk. In this case, you should take the loss, learn your lesson and pay the fine.

JeansAndANiceTop · 18/01/2018 18:57

You can’t actually be serious. Really?
I have a six month old, if there’s no parents spots I park somewhere else. No biggie. How the bugger do you manage to park anywhere else?

ArbitraryName · 18/01/2018 18:57

Tbh, doesn’t everyone who uses a disabled space without a blue badge claim they were ‘only two minutes’?

I always assume they mean ‘about 20 minutes but if I admit that you won’t have any sympathy’.

ArbitraryName · 18/01/2018 19:00

Those ‘2 minutes’ are a bit like the ‘2 minutes’ DS2 claims he needs to finish whatever he’s doing in minecraft every time he’s told to stop.

I thought the OP wass asking about legal grounds, assuming it was on private land not the public highway.

Although a lot of people seem to think it's a wind up?

ArbitraryName · 18/01/2018 19:04

Regardless whether it’s a wind up, I don’t think many people are keen on helping someone avoid a fine for parking in the disabled spaces without a blue badge.

Since you posted in legal rather than AIBU I'd say as it's private probably you parked on its down to the landowners (the supermarket) to pursue the matter through civil courts if you don't pay up.

This process can be costly for them and probably not worth them chasing you for the £60/£100. If, however you were a regular disabled space abuser and had been given numerous tickets there previously they would likely pursue it.

My advice would be to ignore the invoice, that's all it is. If you respond then it's like hooking a fish. 🎣

Shop elsewhere in a better supermarket with enough spaces for all shoppers.

ArbitraryName · 18/01/2018 19:08

But you’d have been able to do a full supermarket shop and have a cup of tea in a cafe in two ‘I’ll just have a look on MN’ minutes. Grin

Paperdolly · 18/01/2018 19:21

I'd be embarrassed to even think this was an acceptable question. 😳

jenniferl1983 · 18/01/2018 19:23

If it is from a parking enforcement company ie UKPC then you could try to appeal. There are threads on MSE that will help.

Although you were wrong to park in a disabled space (2 mins is 2 mins too many) these outfits are purely there to make money and are not interested in disabled rights.

Terramirabilis · 18/01/2018 19:26

Shouldn't have parked in a disabled space. Should have waited or gone elsewhere. But I am a little bemused at the people saying they can't shop if they can't park because they're disabled as though disability is causing this issue. This is true for everyone surely? Unless there are people who abandon their cars in the middle of the carpark.

RatRolyPoly · 18/01/2018 19:27

Lol. Thankfully no parking spaces were occupied in the making of this story.

ArbitraryName · 18/01/2018 19:32

Unless there are people who abandon their cars in the middle of the carpark.

Oh but there are. Haven’t you ever seen a car that has invented their own parking space in a car park? In doing so they’ve usually made it very difficult for people to drive round the car park.

bluesu · 18/01/2018 19:52

I opened up a parking fine today from DH parking in a disabled bay - I was FUMING . How dare he! He claims it was poorly marked, didn't know, yada yada. Short story is - we are paying it.

Suck it up OP. You have no grounds for appeal and you mustn't park in a disabled park for feggs sake!!?! Angry

PigletWasPoohsFriend · 18/01/2018 19:56
