Can I break a tenants lease if I needed my home back for myself ?

I don't want to do this but if I've no other options then I will, just wondered if it was an option, they are a year into a 24 month lease. Thanks

That is one of her 23 page posts Anthony where she already has a home, albeit with some over crowding issues. In it she claims to have put measures in place to get a larger less over crowded home, so why she suddenly needs legal advice on how to get back another apparently owned property is a bit confusing

So you plan on having the mortgage provider begin repossession proceedings and evicting the tenants that way.

Do you believe that the bank will then just let you move back in and everything will be ok?

If you're referring to me Atlas this thread showed up in active and I came to let the poster know that if they're facing homelessness then they have a right to live in their own home and the tennents can be evicted, I didn't know who had posted this before I came on thread.

And the issues op is posting about all conflict and contradict themselves

Yes I believe you can - my tenancy agreement specifies this under Ground 1 Schedule 2 of the 1988 Housing Act.

Are you breaking the terms of your mortgage by letting the house out? Is it not a BTL mortgage?

I can't think of any other reason why the house might be repossessed - but not if you live in it yourself.

essential ground 1 of a section 8 can only be applied after the end of a fixed term - the op's tenants are still in the fixed term.

So your mortgage lender is trying to repossess the property? Is that because you haven't paid the mortgage or because you've let it out without permission? Either way, can't see how living in the property would stop the repossession order so not sure how valid your legal advice is Hmm

The clause about yourself has been in all my contracts both landlord and tenant.
