Hi

So my moronic stupid excuse for a brother stole my equally as stupid moronic mothers car (BMW turbo sport), safe to say he had had his licence for 6 months and had never driven A car since his test. He crashed it into a lamppost they record doing 50+ in a 30 the car was a write off. He has court coming up and wants to know what he is looking at getting Hmm he has said he doesn't want to loose his licence and won't be paying a fine cause you have a fucking choice his mother is saying he's not to pay for the lamppost unless they prove it was working 100% before hand and he is to barter with the punishments..

Now we all know you can't barter your way but she adamant he can and will get a slap on the wrist he needs jail time to say the least HmmAngry

Would any of you know what he's likely to get or could get?
He was;
Speeding
Driving without insurance
Stole the car
Damaged the lamppost by his moronic actions (so damage public property? not sure)
He was driving without due care and attention IMO but nothing has been said but he's not really speaking about it.

He's 21 never really been in trouble for anything serious before and has said he was guilty when he was caught by the police

Obviously he's an idiot but he's being filled without even more idiotic things and we want to bring him back down to earth with what he could be looking at instead of him going in there trying to haggle and saying his mum said not to pay for this and that

Nope, she took him out christmas shopping and spent over £1000 on him as 'he deserved it' All his life he's been treated as if he pisses silver, shits gold and farts platinum. Nothing he's done has ever had a consequence and most likely never will. They've always been entitled she's taught him the world earns him a living and she believes the same it's very sad.

She's brought a new car now but tbh they honestly 100% he will not have to pay the £35/6k back from the insurance company let alone the lamppost and any fines/fee's ect.

ZipZpap They got someone else to fill the form in because "he didn't know how!" He hasn't even read it and won't even know what it say's!

So he now has 2.. yes TWO solicitors because and I'm not joking here "they'll have to see him quickly and get it rushed through as they'll have places to be so they won't be arsed with giving you a proper telling off and punishment"...

That is what she genuinely believes and is telling him. Yes and she is paying for both of them..

How is mother paying for all this madness? Is she made of money? A trashed car, £Ks Xmas gifts, two, not one lawyers, one of which might be a barrister? It beggars belief?

I have installed a large laze boy armchair with all the trimmings for the next instalment. OP how do you keep a straight face around such total fuckwittery?

No Idea if it's a solicitor and a barrister or just two solicitors. However her "they'll have to see you quicker" advice has already proved to be utter crap as they've been in the court house since 10am and are still waiting Grin Grin Grin

He got 12 months disqualified from driving, 150 hours of community service, £85 court fee's £60 compensation to his mother. .They charged him with aggravated theft and nothing about driving without insurance. No mention of the lamppost and no mention of having to re-take his test.. They thought that was enough for him.. I think differently obviously

The retake of the test will depend on the conviction code which goes on his license - an in10 nan for example (ban for driving without insurance) doesn't need a retake of test - but when declared on insurance means most companies won't touch you and those who will charge one hell of a premium. Dvla will decide if he has to retake not the courts. Same with paying the costs of the lamppost - the local authority will claim this separately to the criminal court case.

You're telling me savoy I was expecting chalk outline of where it laid, engineers telling the judge how much pain and suffering it went through and hold long it would take to recover.. But he got neglected poor thing!

Ã’hh so he could have to retake then. I'm not sure who would give him insurance when he gets disqualified from driving for aggravated theft 6 months after getting his licence whilst never holding his own insurance or car haha

And still to come...the letter from the council demanding payment for the lamp post, and another from the Insurance Co to recover the cost of damage to your mother's car. Because surely now with his conviction they will find it worthwhile to pursue him?

The way your mum comes across is that she would allow him to drive her car because he did no wrong and shouldnt have lost his licence.

No idea what happened with the two solicitors tbh! He got legal aid through at the last minute

They genuine believe that is it all done with. Nothing from the council, nothing from the insurers ect they think court means it's done and dusted!
