Hi

So my moronic stupid excuse for a brother stole my equally as stupid moronic mothers car (BMW turbo sport), safe to say he had had his licence for 6 months and had never driven A car since his test. He crashed it into a lamppost they record doing 50+ in a 30 the car was a write off. He has court coming up and wants to know what he is looking at getting Hmm he has said he doesn't want to loose his licence and won't be paying a fine cause you have a fucking choice his mother is saying he's not to pay for the lamppost unless they prove it was working 100% before hand and he is to barter with the punishments..

Now we all know you can't barter your way but she adamant he can and will get a slap on the wrist he needs jail time to say the least HmmAngry

Would any of you know what he's likely to get or could get?
He was;
Speeding
Driving without insurance
Stole the car
Damaged the lamppost by his moronic actions (so damage public property? not sure)
He was driving without due care and attention IMO but nothing has been said but he's not really speaking about it.

He's 21 never really been in trouble for anything serious before and has said he was guilty when he was caught by the police

Obviously he's an idiot but he's being filled without even more idiotic things and we want to bring him back down to earth with what he could be looking at instead of him going in there trying to haggle and saying his mum said not to pay for this and that

Yes the police were called she told them she had seen it all and it never happened when in reality she was in the front garden and we were in the kitchen so didn't see a thing. They're vile!

I don't think he's at magistrates i think he's at crown? I could be wrong though

I will! Driving without insurance on looking online is 6 points so an automatic ban. He should never of been taught to drive IMO he's a serious danger to people! One of these ofc I can drive I played need for speed on the Xbox types

I think you need to get ready to report him for driving without a licence, as that is clearly what's going to happen next. I hope he doesn't live anywhere near me as he sounds like a menace as well as a prize twat.

Eventually he will get a custodial sentence, the only question is whether anyone gets killed first. Would be amusing if he got banged up for contempt of court for trying to haggle with the judge.

Hopefully nobody will get hurt before then. We can hope, however it seems doubtful his first offence bar the odd yellow slip from The PCSO before 16 he is well known to the local police force though

He will be at magistrates not crown. Unless he has already been to magistrates and they decided their sentencing powers are not enough so committed him to crown court. (This would only apply if more than £5k damage)

If at magistrates and he has been charged with 'aggravated vehicle taking' which means nicking a car and having an accident without Injury basically, then there is a mandatory 12 month ban, and a community order is the usual sentence. The community order could have conditions like unpaid work, supervision programme, curfew etc.
He will also have to pay costs of usually £85 if he pleads guilty and likely to have compensation awarded against him.

The above are for someone who has no previous. Whilst it can carry 6mths in prison in magistrates court (more in Crown), he is very unlikely to go to prison on the facts you have given.

There is no chance of bartering though 😂😂

Speeding and driving without insurance are likely to also be convicted but have no separate penalty, although they can in theory sentence each thing separately.

The bartering thing is classic, I've never seen a TV drama where the defendant does this. Maybe he's planning to represent himself, just for extra comedy value? I hope so.

He is in magistrates. I thought you did crown then could get referred up to magistrates but I have them the wrong way round.

By 5K damage is that just to the public property or including the car cause if it's the car then it's over £30K i believe it's around £35/6K from what she's said! He's never been to court before though

I'd just stay out of it if I were you. Don't listen to them, don't give advice, don't even bother ranting about them. Just step back and don't give them any thought. All this angsting and justifiable judging is pointless. Don't be so involved

I presume you don't live with them but I f you do you need to MOVE ASAP
