Moving areas, dds dad contesting this

Following on from another thread I have been advised to post in Legal.

The basic gist is that i want to move @ 4 hours away from my home town but my dds father is contesting this with violence among other things. I am trying to be reasonable and accomodate full visitations as much as possible. Solicitors and police have been informed. Just wondered if anyone had any further advice please?

Don't worry about a thing. I've looked at the other thread and there's no way on earth that he'd be able to stop you moving. Go ahead with your plans. It is extremely rare for the courts to refuse an internal relocation, and that applies anyway to a move between the 3 internal jurisdictions, ie Englan and Wales, Scotland, and NI.

Thank you Resolution. I was quite sure that that would be the case, it's just the off chance that things may go the other way. If we didn't move it wouldn't be the end of the world except that he'll think he has power over me, whether it be through violence or the law.

Good grief.

My first thought is not to tell him your address. Get the PO to redirect anything when you do move, and obviously give him a number to call dd on and an email address.

I'm sorry, I can't give you any advice, other than I agree with Resolution - I believe there is very little the courts can do to prevent you moving within the UK. About 5 years ago a friend of mine was trying to leave the UK for her home country (France) with her dds, post divorce from violent wanker. Her solicitor said if she didn't get permission, there was nothing the courts could do to stop her moving to Dover (from Cumbria!) so at least she could hop over on the ferry. She's now back in France. Smile

Glad you've involved the police.

I suppose the only advice I can give you is to hang on in there! He can't control you, I doubt very much he'll be able to stop you moving.

Thanks Bertina. Glad your friend is where she wants to be now :)
