I'm thinking it was accidental/freak circumstance or he had some kind of condition which they are unsure of the fight bringing on......

According to the Sun today, hes was hwead butted and pinned down while the other kid punched him.
It looks as though he had some kind of fit and died almost an hour later.
This story is frightening as bullying is getting out of control. Could the teachers maybe do more?

I dont think the teachers can do more as we all know anyway their hands are pretty much tied. In addition, it isn't their responsibility to ensure these things dont happen. I assume they wouldn't turn a blind eye if they saw it just they cant be there every second of the day and bullies are notoriously sneaky f*ckers. Sorry but I think this sort of behaviour comes from home and/or outside influences such as tv/games etc. However I do suspect a lot of schools dont admit that bullying is as big a problem as it is (im not talking the teachers here but more the management/governors). I know our Chair of Governors boasts in his annual report that they do not tolerate bullying and is happy to report that none goes on in the school - well I can vouch that it jolly well does. My ds has been picked on for 2 years by a teachers kid and when ive discussed it with his last 2 teachers I am told that G is just boisterous and clumsy! Also know of several other instances one of which moved school to get away from the bully and another year 4 boy threatening to commit suicide.

The probelm is not so much when the kids are in classes, but when tey are outside at break of luch or moving from class to class. We have duty at set times, we also have cover/break/lunch supervisors, but they can't be everywhere at once. I have split up a few fights in my time, I was lucky enough to see them start. But unless the kids are marched in line from class to class and 'observed' through breaks etc I don't see what more the staff can do.

there was some nasty fights at my old school where kids were knocked out

poor lad. Dont think you will ever stop fighting in the playgorund though

the use of weaponary is very scarey though I know it didnt happen in this case but the other cases mentioned, very frightening

I am frightened to get the full story, its so worrying when you think how bad its getting. My kids are still very young and im so scared.

i have not seen the news, but if the sun (thanks tammylove) has reported accurately, would these kids be charged with murder, surely it must be the case or manslaughter? although certainly am not an expert on law, it is very sad. My thoughts are with the families involved.

If this was the case then surely it is still murder as per the eggshell skull rule or whatever it's called? (Ie if you hit someone on the head and their skull is very thin and shatters and they die, even though a person with a normal thickness of skull would have survived fine you are still guilty of murder)

one thing is for sure, teenage kids are amazingly bad at understanding that their actions can have real consequences. What an awful thing to happen.

I still think that kids of 10 know that dead is dead tho. And I was never one of the string 'em up brigade. I think that they are very damaged kids , who did a terrible thing. They need help and I don't think that saying 'they didn't understand' will help them. I think that they have to accept their guilt as part of moving on. I also posted that I feel it is important to know why some kids act like this while others, given the same upbringing, do not. And the people most responsible are the parenst of the two.
