Harvey is in residential care, which she has shamelessly taken him from on a couple of occasions to appear at paid for club nights where people pay entry and extra to have a photo with him.

Is Harvey able to give informed consent to this? (If true) it sounds uncomfortably close to exploitation.

Custodial sentences aren't just about punishment and judgement, they're about forcing people to be accountable and have natural consequences to encourage them not to reoffend.

It's not all about the offender. Let's not forget protecting the public. If a drunk/drugged up driver is in jail, he or she isn't putting lives at risk.

I obviously can't speak to his ability to give informed consent but I can't imagine he would meet the welfare threshold for agreeing to paid for activity in a nightclub with many of his stressors (flashing lights, noise, big crowds etc) in particular. I'm disgusted she put him in that position.

100% as someone who nearly lost their life due to drink driver, and has life changing injuries as a result, I absolutely agree menaces should be kept off the roads.

And like I said upthread, fines / suspensions / points / community service / disqualifications etc haven't worked for her so IMO she should now be in a position where the only thing a judge can consider for a driving offence is a custodial sentence.

Anything else an insult to people like me and the ones who were far unluckier and lost their lives. And shows a complete disregard for the general public vs one repeat offender who happens to be a celebrity.

No other person with this amount of criminal goings on, would be spared jail. It's an absolute shit show.
There are mums out there that have been shoved in jail for less than her, hard up, desperate mums. She just keeps on getting away with it.

One of the first replies and spot on.

It's elitist crap all over again.

But then our government have now set that standard so we are fucked.

When did I say breaching a restraining order was not punishable by imprisonment? My points were a) I'm surprised people commenting think that the specifics of this breach of the restraining order (as reported in the article linked ..I haven't looked into it further) warranted imprisonment (regardless whether it's legally the usual/standard punishment I'm just surprised that people would read the article and think "wow she should have gone to jail for that") and b) explaining that there are sentencing guidelines in place that affect whether or not custody is granted EVEN if the crime CAN be punishable by custody. It seems to me that the lawyers for KP just did what they were paid to do to get the best outcome for their client and the judge has followed the law. I'm simply countering the arguments implying that something has occurred here which is outside the realms of what might have occurred to someone other than KP in similar circumstances.

@Rosiestraws a restraining order doesn't have a:sliding scale of breaching etiquette,

My ex breached my restraining order by 'accidentally' friend requesting me on LinkedIn. It was taken very seriously.
