The "Big Man" on the train - charged with assault.

I am sure you have all heard about the gobby young man who was refusing to get off the train and a large gentleman offered to help the elderly guard to get the gobby kid off the train so they could all continue their journey. So he grabbed him lobbed him off, his face was quiet seriously cut to be fair.

Now the "Big Man" who was a hero to many standing up to the gobby youth, has been charged with assault. I'm not surprised to be honest, whilst I have a sneaking admiration for his actions it was assault.

I hope the judge is generous with a conditional discharge though.

the young yob who was foul-mouthing in the packed train and who tried to trip the elderly guard was not charged?? wonderful.

Good. It was assault. He is not a hero, he's someone throwing his weight around.

There would have been a lot of people on that train hacked off with being delayed by gobby who had also paid through the nose for their tickets because they partially subside the fare dodgers like gobby.

He was out of order though, just don't want to see him punished harshly, yes he has to be charged, but a smack on the wrist should suffice.

Well they were stuck. The BTP have said it could have taken up to 2 hours for them to get their and remove him (although after the incident so the Big Man might not have known that, depends on his experience I suppose). If I was going to be stuck on a cold train until 11.30 at night I would want to do something about it. They could have got off and tried to get different transport but all the following trains stuck between station would have been full of truly stuck people.

It was a massive over reaction. Young man should have been dealt with by TPolice. If he'd have hit his head and died, the man now facing assault charge, would be looking at years away from his own family. And for what? an unpaid ticket, would it really have been worth heartache all round.

I find it odd that in this conflict where two people were in the wrong only one gets the full blow of the law. I would be going after the yob to the maximum to show that his behaviour was totally unacceptable. Not to say that the vigilante guy should get no punishment for this actions.

I'm almost certain he will be fined accordingly, if it's proven he didn't have a ticket, that only seems right and fair.

But what would they charge him with bemybebe? I don't see any evidence of him trying to trip the conductor and I doubt they could charge him for not having a ticket without evidence (it was his word against the conductor's).

I'm fairly sure the Scottish press reported that the wee ned got charged as well (or fined at least).

apparently both have been charged. gobby slightly drunk lad had a ticket but not the right one (anyone made that mistake before). Big bloke could easily have man-handled him off the train but chose to chuck him off instead. As someone above said - but for the grace of god, he would have been done for manslaughter.

There were witnesses that said he did try to trip the conductor (probably not an offense). He traveled without a valid ticket (is conductor's word not enough??) and he did swear in public. I think there is enough at least for a trip to the court.

Next time I travel to NY with BA I should try the trick of "having the right ticket, just not on me" and no I did not "make this mistake before"... the "wee" guy was just trying it on.
