"Rough sex gone wrong" defence being wheeled out again

They'd only been together 3 months. He's pleaded guilty to coercive control (and several ex girlfriends have come forward with allegative of coercive control too). He allegedly forced her to have sex with another man, forced her to be filmed doing sex acts, and got her to transfer £6000 to fund his cocaine habit.

This bit makes me furious: "He also denies four counts of rape and one of intentional strangulation." No - he has literally admitted strangling her, but said that she consented. That isn't meant to be a defence anymore.

Rest in peace, Olivia. You deserved so much better. I hope he's found guilty and never gets out.

He sounds very abusive. I hope she gets justice.

Well, I guess he can state it, doesn’t mean anyone will take any notice of it.

It’s section 75A(3) SCA 2015 (of the Serious Crime Act) which states the defence does not apply if:

  • B suffers serious harm as a result of the strangulation or other act, and
  • A either –
  • intended to cause B serious harm, or
  • was reckless as to whether B would suffer serious harm.

I don’t know how the process works but presumably if/when he’s found guilty, the judge states it’s not a relevant defence for the purpose of sentencing?

Serious Crime Act 2015

An Act to amend the Proceeds of Crime Act 2002, the Computer Misuse Act 1990, Part 4 of the Policing and Crime Act 2009, section 1 of the Children and Young Persons Act 1933, the Sexual Offences Act 2003, the Street Offences Act 1959, the Female Genita...

This doesn't apply in murder cases.

ZookeeperSE · 31/03/2025 12:38

Oh I see. Was there ever any changes to sentencing law surrounding this then? Or was it just spoken about but not enacted?

PermanentTemporary · 31/03/2025 12:46

Given that her hyoid bone snapped, I'd infer that she suffered serious harm.

What a total waste of breath that man is.

This goes back to the campaign by the group We Can't Consent to this. They were very much concerned with cases where the victim was killed. But they seemed to have been very poorly legally advised, as the change they were seeking was pushing again the centuries old traditions that allowed for the offence of manslaughter instead of murder, where there was insufficient proof of an intention to kill (where as in this case, the victim has died). So even if Goodwin is acquitted of murder, he will still be guilty of manslaughter - and subject to whatever sentence the Court then decides to impose.

Just another warning to us women to be very careful when we are choosing who to date/ allow into our lives. Poor Olivia, rest in peace.

Redflagsabounded · 07/05/2025 09:17

Dear god. Also found guilty of coercive control, rape, assault and strangulation of 3 other women.

How could he get away with this again and again.

Yes, I'm genuinely surprised this case hasn't had more coverage. Absolute monster of a man who has abused women wih impunity for years. Pretty, middle-class girl.
He got 35 years anyway.
