Anyone got any experience of a someone being Sectioned?

A friend of mine was sectioned last week, and their family are not the most clued up.He has been deemed to be a danger to himself and others, and although he is schizophrenic has not been taking any tablets etc.
What happens to his financial side, does his family have to inform the bank, as the hospital letting him keep his bank cards( which I find odd). Should his account be frozen whilst he is under the section order?
Have also posted this in the legal section in case a legal bod can help.

Hi, I am a mental health nurse. It is a tricky situation really, but he still has certain rights and I don't think he should necessarily have his bank card removed. Is he overspending? If so a family member might make the decision to advise the bank of the situation. Why do you find it odd that he has his bank cards? If he goes out on leave (authorised leave I mean) he will need/want access to his money.

Do you know what section he has been detained under?

If he is in receipt of benefits, the ward clerk or similar person will advise on how long he can receive the same benefits. (If he is in hospital for a long time then some benefits may be reduced)

p.s. going to make dinner/bath kids etc now but will be back later.

OPOL- Thank you so much for your reply. No idea which section, but its something to do with danger to himself and others.
I find it odd that he has kept his cards, as I thought it was similar to being in prison, you weren't allowed to do anything and kept under watch.
Do the bank have to freeze his account if he is detained under section? He is still employed so has his salary coming in ( no benefits I am aware of, although I guess this will reduce down to sick pay sometime soon. He hasn't been at his job for over 3 months.

lol no its not prison

he will have a period ofassessment when he cant leave the h without supervision

but you retain your right to manage your own affairs

i doin't think his family can interfere

The bank does not need to be informed at all unless there's a particular problem that they might be able to help with- eg he is in debt to them and it would be helpful for them to back off untill he's better.

have experience of this once removed as my dad is dealing with his mother's affairs. she was sectioned in the summer for a short time and subsequently diagnosed with (pretty advanced) Alzheimer?s. As she was sectioned, my dad is having no end of trouble getting the equivalent of power of attorney. The law gives people who are sectioned lots and lots of protection and my dad's been through endless hoops to get the doctors to sign a letter (£££) to say she was sectioned, she is ill and cannot manage her own affairs. It's been going on for months and months and they need to sell the house to pay for her care.

Not simple or easy.

Very generally speaking everyone who is on a Section will be sectioned because (as a result of their mental illness/disorder) they pose either a risk to themselves or others, or are at risk of their health deteriorating further without the right intervention.

The most commonly used sections (in hospital) are Section 2 and Section 3 of the Mental Health Act.

Again speaking very basically/generally, Section 2 is for assessement and lasts up to 28 days. In theory during that time a diagnosis will be made, (or indeed a decision made that the person does not have a mental illness.)

The person then may go on to be regraded to a Section 3 for treatment. (or the person may become more aware of their situation and chose to accept some sort of treatment voluntarily).

A Section 3 initially lasts for up to 6 months. (this can be extended but certain conditions have to be met). The person will be detained for treatment, which in some circumstances can be enforced, e.g. by injection but this is fairly rare.

People who already have a diagnosed mental illness and need sectioning obviously don't need assessment so would be admitted under Section 3.

I stress that this is a very basic overview. Hope it is helpful.

Your friend will only have items removed that may pose a risk to himself or other patients. e.g. razor blades. Some hospitals have stricter policies than others.

they are allowed to keep their own cards and money. They are detained under the mental health act and will not be going anywhere for the time being (unless he has a section 17 which allows for leave) If he goes out with the staff, he is allowed to spend his money. It is not prison. Having his own cards or money is not endangering his life or others.

Thank you so much for all your help everyone. I can tell the family to stop worrying they don't need to do anything re his bank. I guess he is there under a section 3 order as he has been diagnosed for the last 2 years, voluntarily, but has recently stopped medicating and has become increasingly violent and unstable. Am so to see my friend like this, and hope he can find his equilibrium soon.

Incidentally changedforprivacy, your friend will have a "named nurse" (may be called something slightly different) and his family can ask him/her for general information or advice if necessary.
