PIP mandatory reconsideration

Hi -
Not sure anyone can help me. I’ve applied for PIP due to my cognitive issues and anxiety. It was rejected and now going through mandatory reconsideration. Since they turned it down I’ve been diagnosed with autism and adhd - but they say they can’t accept this and will need to make a new claim? I did mention in my original claim that I’m awaiting assessment?? Has anyone experienced this before? Thank you

That's odd. When I first claimed and spoke with the assessor, I said I was expecting to have an appointment for an ADHD diagnosis. I was told to phone them afterwards and let them know. I did that but then they wanted to do another assessment but I declined.

MissAndrey · 02/04/2025 15:20

Do you work?

drspouse · 02/04/2025 15:22

I don't think you can add any information to a MR, we had this for DLA (was awarded after MR) but it was supposed to just be based on the information previously submitted.

How is that relevant?

OP, I think this is correct. There has been a decision, so you can appeal that decision based on your position at that time, but you cannot add new diagnoses and have those considered - they are reviewing the position at the point of refusal, not any changes to it. It would be the same if your claim had been successful. A substntial change triggers a new assessment (assuming you were successful) so I would think that you would need to apply again if your diagnoses significantly changes.

CheesyRaver · 02/04/2025 15:35

Pip isn't diagnosis based,it's based on what you can and can't do, it shouldn't make a difference (although in reality it probably does) if the mr is declined you can send additional info if you take it to tribunal.

Have you been through the assessment decision and sent evidence for each of the descriptors you feel you should have scored points on? You can still send this to them as long as it is from before you initially claimed.

You can still make a new claim whist this one is being processed if you want to include the new diagnosis prior to tribunal.

Baconmaple · 02/04/2025 15:35

I think you have to decide whether to go ahead with mandatory reconsideration without the additional info or new application with it. I guess decide what the chances are. Difficult decision. I'm assuming you can't do both at once but might be worth finding out.

Baconmaple · 02/04/2025 15:36

Ah someone has provided the info while I was typing.

CheesyRaver · 02/04/2025 15:38

Further to the above, I'd also argue that as adhd is present at birth, if you have to go to tribunal, it's clear that you had these conditions at point of assessment and that these contribute to why you can or can't do things.

So even if all my struggles have come from my autism and adhd and that I mentioned I’m awaiting my assessment? All seems crazy to then have to reapply all with the same symptoms and same problems. It’s not like I caught autism lol! And yes I do work to whoever asked

But the assessment is made based on what you can or can’t do, presumably that hasn’t changed with your diagnosis?

Nonametonight · 03/04/2025 15:31

You definitely don't need to reapply.

Pip is based on how you're affected, not your diagnosis.

A MR or appeal can't look at things in your life that have changed since the assessment (eg if since being turned down you were in a terrible accident and lost your leg), but getting a diagnosis for a developmental difference you've had your whole life isn't that kind of change.

Send in the evidence of your diagnosis now, and be ready to go to appeal if needs be

NickiB85 · 03/04/2025 15:32

No nothing has changed with how I present but surely it holds more weight with a diagnosis to confirm my struggles.

It isn't about holding weight, though. It's about how many points you scored on the basis of what you can do.

BobbleBobby · 03/04/2025 15:43

If you mentioned autism/ADHD in the conditions section of claim & that you were awaiting assessment then it should be considered and your not informing them of a new condition just confirming diagnosis with the report submitted as evidence for your file.

As it's based on ability to perform activities rather than condition and its not likely the symptoms/reasons have changed since you answered.

On my friends last review the MR reasons just seemed a lot of copy & paste and didn't even make much sense but they wanted to underscore 1 point in area had always scored higher in past. They submitted an appeal to tribunal service and couple weeks later DWP awarded and closed it.

NickiB85 · 03/04/2025 16:08

@BobbleBobby yes that’s what I thought. It’s nothing new and I mentioned the assessment in my claim form and that I should be receiving my assessment any day so hopefully they take into account x

OP posts:
BobbyBiscuits · 03/04/2025 16:17

If you put those conditions before and are now diagnosed I'd assume it's part of same claim?
You just add anything that's new to prove your illnesses during the appeal or whatever it's called. Good luck. X

BobbleBobby · 03/04/2025 16:24

The do often score low so people give up as it saves money. There wouldn't be 70% of cases awarded in claimants favour at tribunal if DWP was fairly assessing people.

NickiB85 · 03/04/2025 18:33

thank you so much everyone, you have all been really helpful xx

Hi
Has anyone had a mandatory reconsideration overturned , and won ,as just in the process of doing one .
thank you

countingthedays945 · 07/05/2025 20:35

Stop focusing on the diagnosis and focus on what you are functionally able or not able to do. Why does that change with a label?

Caitlyn59 · 09/05/2025 18:34

Hi , I phoned to do mandatory reconsideration, they said they would do it there and then over the phone , anyone can advise, is it best to send it in on writing also what I disagree with ,
thank you
