Bought some shoes off Ebay, they say they are a size 6 but they are clearly not - what to do now?

I'm really disappointed. I spent quite a lot of money for me, on these shoes that are just ace, but don't fit! They say in the shoes that they are a size 6, but I'm a size 6 and they are way too small. I've compared them with my other shoes and they are obviously a size smaller. They are not American sized, it definitely says UK 6.

The woman who sold them had in her description that she was selling them because they were too small for her, having bought the wrong size by mistake.

Am I entitled to a refund?

What does the label on the shoes say? Does that say 6 too?

Have you asked her? She must know they aren't really a 6.

Yes she advertised them as a 6, but said in her description of them that they were too small for her because she had bought the wrong size by mistake, so I assumed she must have wanted a size 7.
The shoes also state they are a size 6.

But there is no way they are a size 6. I can't wear them, they'd cripple me.

Was it the shoes or the description that said they were a UK 6? It sounds like the shoes are a US 6 and she doesn't realise this.

Not sure if it's her fault, the shoes do state they are a 6. But her admission that they were too small for her makes me think that perhaps she knows they are wrongly sized.

Am I entitled to a refund in this case?

I have contacted her and am awaiting a reply, but not sure where I would stand.

Difficult one. She could claim that as they were labelled as a 6 that she sold them in good faith. If I was her I'd refund and resell them as a 5 though.

A lot of styles come out smaller than others, I know I am anywhere between a 6 and 71/2 depending on the style and make. TBH I don't see that she has done anything wrong. THey say a 6 and she said 6... frustrating though. Could you sell them on?

that's happened to me too, and I was angry and felt that the seller had been disingenuous at best

but I didn't feel I had a leg to stand on so chalked it up to "the pitfalls of buying stuff on ebay"

was pissed off though!

No Soupy, the shoes say they are a UK6, her description said they are UK6.

But they are not. I can't put my feet into them and when compared to my other UK6 shoes, they are definitely a size smaller.

(sigh) I thought this might be the case. Very annoying as I paid quite a lot for them, more than I normally would. I can ill afford to lose that.

I could relist them, but I'd have to relist them as a 5 even though they are labelled as a 6.

So so annoying.

If you dont get anywhere with the complaining maybe it would be worth relisting them as a 5 explaining that they are wrongly labelled as a 6 etc

It depends how much you paid and how much you can sell them on for I guess

Cheers, I do think she must have known, but what she gets out of selling them like that I don't know. Why didn't she state that they were small for a 6? I wouldn't have bought them then! She'd still have sold them probably, to someone who would have been happy with them. Why create this trouble?

Did you pay via paypal? You have a chance of getting your money back that way given that the shoes are technically faulty because of the incorrect size.

From the seller's perspective. . .

I sold a pair of shoes on ebay last year that were a UK6, because they didn't fit me very well and rubbed wrong in places. I find this happens with lots of size UK6 shoes, though UK7 is nearly always too big. Has more to do with me having wider feet than not being a UK6--certain styles work, others don't. Turned out the girl I sold them too had problems with them as well, but I only found out because she wrote in her feedback that she was going to have to sell them on due to being too small for her.

Your seller could genuinely have believed the shoes were a UK6, but were just too small in that particular style. I've done that several times, where I can get the UK6 shoe on, the larger size flops around, so I buy the smaller--then later realise it was a complete mistake.

I really find shoe sizes vary from style to style, wouldn't jump to the conclusion that she was being devious. But I am very used to shoes not fitting me, which is why I don't personally like to buy them online.

I think it WOULD be wrong to relist them as a 5, as that's not what the label says. If you want to put in the description that you think they seem quite small for a 6, that's fair enough.

Its possible that she doesnt think that they are wrong. There is some variation in shoe sizing, depending on the brand.

Contact the seller to discuss it. I don't beleive you are automatically entitled to a refund as like other say, and sadly like other clothing sizing varies so widely according to brand.

Yes seller should have put this in the listing if she was aware they are a "small 6" but she may be genuinely unaware - maybe she actually is a 7 and picked up wrong size. But then again what numpty would actually do that !!)

If she is a decent seller (I would) she'll offer to refund you (possibly not p+p though) as she's not really in the wrong.
If however she is not a decent seller you maybe stuck with them - and like you say state clearly that although size is stated as UK 6 your standard UK 6 size feet would disagree.

Well I contacted the seller. She said her boyfriend bought them for her in London so she couldn't take them back. He thought she was a size 6 but she's a size 7. She says she could just about wear them but they were too snug.

She's refused a refund, saying I'll have to re-list them on ebay.

Honestly though, there is nothing wrong with the width but they are really NOT a size 6. If I advertised them as that then I'd be deceiving people. My toes are all scrunched up in them - there is no way if she is a size 7 she'd have got them on her feet! Lengthwise, compared to my DMs and other shoes, they are clearly a size smaller.

As I used my credit card, could I have a claim with them do you think?

you could email again and say you'll start a dispute, maybe that'll make her think that it's better to just refund you.

if she clearly didn't mention that she thought they were a size smaller than 6 you could win the dispute over them being not as described.

She's a cow - although I do not state I accept returns I would take back any item a buyer wasn't happy with - not off-load and scarper. You may as well try a dispute now.

You think so? I've just done a search on ebay and found out that I'm not entitled to a refund. If it states on the shoe that they are a size 6 and that's what she put in her description, then technically I can't claim.

I'm relisting them, but I don't want to mislead so even though they are sized as a UK6, I'm selling them as a 5.5. But I am explaining in the description about the size problem.
