Am really p'd off, do I report this as item not received, or do I wait? (really long - sorry)

OK, I'll try to keep it short.

At the beginning of Aug, I bought a bed from a seller on ebay. It was for dd2's redecorated bedroom, she was v excited. They deregistered from ebay, and after an exchange of emails, and finally a threat of small claims court from me, I had a refund.

On 26 Aug, I then bought the same model bed from another seller, I checked their feedback carefully first this time, and was happy that this time we would get our bed. I paid by PayPal straight away. I had emailed the seller first to check they could deliver to us, as we are outside their delivery area, she quoted me an extra £20 on top of their normal delivery charge. I was happy with that.

Here is the sequence of events since then.

30 Aug, get an email from the seller thanking me for payment, I email her back to ask when we can expect delivery, and explaining that I have been let down once before. She emails me back, commiserating with my experience, and says she hopes to arrange delivery "within a week, but it may be sooner if you can accept evening delivery"

I emailed her straight back thanking her, and giving her my availability for the next week.

4 Sept I email her asking if there is an update. No reply.

7 Sept I email her again saying I hope I haven't been let down again, asking that she at least acknowledges my emails. She emails back the same day saying "no you haven't been done - as you can see by my feedback I'm a reputable seller, so relax". She says she is sorting her Wales run over the weekend and will be in touch in a few days to confirm delivery. I reply to her in a conciliatory manner, as I don't want to get her riled and get bad feedback.

14 Sept still nothing from her, so I email asking if there was any news. She replies saying that the bed will be delivered on the evening of 26 Sept.

26 Sept, we sit in all night waiting and guess what? The bed didn't arrive. I sent them an email asking for an explanation as to why the bed didn't arrive, and asking them to let me know whether they could deliver within the next 7 days, and if not, then I would like a refund.

29 Sept, I still didn't have a reply. Sent another email saying I understand that unforeseen circumstances arise, and that I wouldn't mind so much if they would at least acknowledge my email, but that if they were a reputable business, they would at least keep customers informed of what is happening. (I started to think that perhaps they had had a death in the family or something, and didn't want to really go mad at them just in case).

Anyway, I have still not heard anything. They are still receiving feedback, so are presumably delivering stuff to some of their customers, their ebay shop is still fully stocked, and they're still selling the same bed that I ordered, so I am at a loss to think of a good explanation as to why this has happened.

So, do I report this, do I wait a bit longer? I don't have anything but an email address for them, and frankly I am getting more and more pissed off with the whole thing.

i'd report this item as not received ,surely if seller wants a continous feedback then the bed would and should have been delivered.
i'm sure once its reported you will get a reply !!!!

OK, I think I'll give her the 7 days I referred to when I emailed last Wed when the bed wasn't delivered. That takes me to tomorrow, I'll then email her to say I'm going to report it, and then if I still don't hear anything, I will report it.

Don't wait any longer to file a dispute - I'm not sure, but there is a time limit. - I'll look it up in a mo before I panic you.

Can you pull her contact details and give her a ring?

ok I checked - You can open an Item Not Received or Significantly Not As Described dispute 10-60 days after the day on which the auction-style listing ended or you bought using Buy It Now (the "transaction date")

How do I get her phone number then? Can I ask ebay for it? From my calculation, I have another 30(ish) days to raise a dispute, which I don't really want to do, but the bed wasn't cheap - £255 including delivery, can't afford to lose that...

She's not being very professional about the whole business.

As you've contacted her on numberous occasions and have been polite, i'd send her a final email saying that due to her reluctance to communicate with you, and as you have not received the item or a refund, you are left with no other choice but to file a claim, state that you would not like to do this and you really would like the item and see what happens.

There must be something up if she has not received any negatives fo a non preforming seller

Well, I've just emailed her saying that if I have not heard from her by close of play today, I will be reporting it as an non received item.

Have also got her phone number from ebay, but at the moment am too scared to use it!!! How pathetic!

i would definately report it. im an ebay seller/buyer and i certainly wouldnt put up with her lack of responce. From what you say you have been polite and v reasonable. For what ever reason she hasnt delivered the bed. But once reprted you can then claim your money back from paypal.

Bad luck having had one ratbag ebayer but 2! wow!!

Just had an (almost instant) response to my email, saying

"i am really really sorry but i have been taken away unexpectedly , i won't go into detail but my Daughter has had to manage as best she can - all i can do is apologise profusely and i will sort a new delivery out TODAY / THIS EVENING for you

Please do not think that you will not get your item as you most certainly will but i have had to pick up where i left off so im glad that you made contact again, however i can see why you are concerned
I will e mail you this evening although it will probably be a late one
My apologies"

So I'm glad that I wasn't too nasty, or I would be feeling really guilty right now...

AAAAAARRRRRRGGGGGGHHHHHHH!

I had been promised delivery this evening by this bunch of idiots, but guess what? I had an email just now saying:

"I hate to disappoint you yet again but as i am out of the Sleepers due to having to return my last two as damaged and expecting replacements i have been informed by the suppliers that the next shipping is 29th October, if you would like to wait then i will return £20 of the delivery charhge for your inconvenience and will deliver on the 29th - alternatively i can forward you a cheque as a refund sent with my sincere appolgies.
Please get back to me as soon as possible"

I simply cannot believe this!!!!!

I have emailed her back saying that I want my money back, and I don't want a cheque in the post, because of the postal strikes, I want it delivered by courier, or paid into my Paypal account.

What is particularly annoying about this is that she is currently selling 5 of the same bed on ebay at the moment, all on "buy it now". Surely she shouldn't be selling something that she doesn't actually have...

i would defo ask for a refund she is taking the piss

defintaley ask for paypal - how did you pay?

and why should you have to wait for cheque to clear - if you paid through paypal just claim through them satright away and i bet she gives you your money straight back

have you a picci of the sleeper or the item number maybe they have it somewhere more reliable

I paid through Paypal - and I hadn't thought about the time for the cheque to clear. Think I'll go back to her and say I definately want Paypal.

Does anybody know the rules about advertising something for sale when you don't physically have the item?

yes you can complain through paypal saying that the item's description isnt true because she says she physically has it i had to do this a few weeks back becasue i never recd something and was refunded within half an hour

OK, so I put in a claim through Paypal for my money back. The seller did not respond within the time required, so I was awarded the claim by default.

HOWEVER, I had the following message from Paypal

"We have completed our investigation of this case. We attempted to process a refund from the seller's account to your account. Unfortunately, the seller's account does not contain the funds necessary to cover this refund. We were able to recover £150.00 GBP. We have taken action against the seller and are working to recover the remainder of your refund. We will contact you when we have more information. No further action is required of you at this time."

They owed me £255!!!!! Am I supposed to just sit here and wait? This has really shaken my faith in ebay.

Can I contact the seller independently and say I'm going to take them to the small claims court for the rest? How long do I have to wait?

I am really NOT HAPPY.

Oh, and another question. I haven't left any feedback yet. Am I within my rights to leave them negative feedback now? I really don't want any negative feedback in return, but I fear that is what will happen...

If they are still trading I reckon paypal will grab the money for you as soon as some gets to their account.
I'd avoid contacting them for the time being - it may prompt them into making sure no funds reach their account.

you must leave feedback yes! you need to warn others (that's what FB is for)
if you get a retalitory FB just reply to it calmly stating that it is a retalitory neg - it won't make you look bad.

Do they still have items listed?

Dont leave anyfeedback and don't communicate at all until you hear from paypal. I'm sure you will get your money back eventually if paypal are sorting it out for you. When it's been cleared up I would leave it at that. Don't leave any feedback and don't email them.

Well done for putting your paypal claim in in time!
The time limit is something like 40 days. I got caught by a mumsnetter keeping me hanging on with excuses and by the time I realised I'd been taken for a fool it was too late to get my money back

You still need to file a non recieved item on Ebay.

This is exactly why I never pay that much unless I am paying cash on collection or cash on delivery which is waht a lot of good honest sellers allow on Ebay.

I believe there are hamster - but I'm thinking rather than rush in and report and force them to stop trading it might be best to hold off until they have traded some more (legit hopefully) and then money gets to paypal and then to emsie.
Once all money is refunded report like heck!
