Am really p'd off, do I report this as item not received, or do I wait? (really long - sorry)

OK, I'll try to keep it short.

At the beginning of Aug, I bought a bed from a seller on ebay. It was for dd2's redecorated bedroom, she was v excited. They deregistered from ebay, and after an exchange of emails, and finally a threat of small claims court from me, I had a refund.

On 26 Aug, I then bought the same model bed from another seller, I checked their feedback carefully first this time, and was happy that this time we would get our bed. I paid by PayPal straight away. I had emailed the seller first to check they could deliver to us, as we are outside their delivery area, she quoted me an extra £20 on top of their normal delivery charge. I was happy with that.

Here is the sequence of events since then.

30 Aug, get an email from the seller thanking me for payment, I email her back to ask when we can expect delivery, and explaining that I have been let down once before. She emails me back, commiserating with my experience, and says she hopes to arrange delivery "within a week, but it may be sooner if you can accept evening delivery"

I emailed her straight back thanking her, and giving her my availability for the next week.

4 Sept I email her asking if there is an update. No reply.

7 Sept I email her again saying I hope I haven't been let down again, asking that she at least acknowledges my emails. She emails back the same day saying "no you haven't been done - as you can see by my feedback I'm a reputable seller, so relax". She says she is sorting her Wales run over the weekend and will be in touch in a few days to confirm delivery. I reply to her in a conciliatory manner, as I don't want to get her riled and get bad feedback.

14 Sept still nothing from her, so I email asking if there was any news. She replies saying that the bed will be delivered on the evening of 26 Sept.

26 Sept, we sit in all night waiting and guess what? The bed didn't arrive. I sent them an email asking for an explanation as to why the bed didn't arrive, and asking them to let me know whether they could deliver within the next 7 days, and if not, then I would like a refund.

29 Sept, I still didn't have a reply. Sent another email saying I understand that unforeseen circumstances arise, and that I wouldn't mind so much if they would at least acknowledge my email, but that if they were a reputable business, they would at least keep customers informed of what is happening. (I started to think that perhaps they had had a death in the family or something, and didn't want to really go mad at them just in case).

Anyway, I have still not heard anything. They are still receiving feedback, so are presumably delivering stuff to some of their customers, their ebay shop is still fully stocked, and they're still selling the same bed that I ordered, so I am at a loss to think of a good explanation as to why this has happened.

So, do I report this, do I wait a bit longer? I don't have anything but an email address for them, and frankly I am getting more and more pissed off with the whole thing.

I got ripped off £50 from a mumsnetter once and I never did get my money back to this day!
They emptied their paypal accound and just opened a new one, If funds ever go back into that account they will refund me straight away but i doubt they ever will!

Hope you have better luck than i did

Have the funds from Paypal come from a credit card because if so you may be able to get the money back via them?

So the general consensus is wait for a bit to see whether I get more from them - they are still trading and even selling the same bed, (which they told me they don't have in stock until tomorrow )

I will hold back on emails, feedback etc until I get the rest of my money...

OK, so another question. I have no money yet in my Paypal account. How long does it normally take for money to arrive in a Paypal account in these sort of cases?

Anyone any clue?

This saga continues...

Having had my £150 refund, I have been waiting patiently to see whether Paypal manage to get me the rest of my money. I held back on posting any negative feedback, and have not emailed them direct.

I have been periodically checking on the seller on ebay, and watching as they have had more and more negative feedback coming in. Today, I went to check, and they are no longer registered with ebay!

Does this mean that Paypal will no longer be able to get my money back? (I have emailed Paypal to ask this question).

I have an email address and telephone number for these people - do I use them? I'm not scared to take someone to the small claims court if necessary.

Or should I write this off to experience, never buy anything this expensive on ebay again, and move on?

I don't know for sure how this works, but I believe paypal still chase money owed whether registered with ebay or not. If this is the case I'd imagine it could take some time. I'd be interested to hear what your reply would be.

I'd be tempted to give these people a phone call. Maybe start the conversation with "I am calling on behalf of Ms X... continue with, I would like to inform you that should the money not be received within 14 days we will proceed to the claims court and all costs involved passed onto yourself" (or something)

I am so sorry you have lost so much money emsiewill and i shall keep my fingers crossed for you that you do eventually get it back.

I have a rule of never spending a large amount on ebay - unless it was a cash on collection. Sometimes the bargain isn't worth the risk. But that's only my opinion (I'm with Mulder - Trust no-one )

What paypal protection they they offer btw?

paypal got me a refund for a transaction that wasn't through ebay. i don't think they have to be a registered seller.

I shall wait for Paypal's reply. If they tell me they can do no more, I think I will email the seller direct, telling them that I will be talking to a solicitor, which sets me up for the phone call from "my solicitor" (me with a posh voice!).
