right cliff notes version

item won 23rd april, cheque sent 24th april, cheque cashed from my account 26th april. (assuming 4 day clearance in her account 2nd may)

I emailed on the 3rd may and also 6th may to ask if everything was ok, and also that I had sent my details to her.

I have had NO reply as of yet.

her listing states "Cheques/Postal Orders/Bakers Drafts to be recieved within 7 days (Item will be dispatched on clearance off the cheque)" now i've paid for 1st class postage so it should be with me by now.

what should I do from here? I don't want to risk neg FB but also I want her to at least respond/aknowledge my emails.

I'd ask ebay for her contact details, they'll give you a telephone number in situations like that. Maybe her computer's gone down?

munz · 09/05/2007 11:26

I know i'm torn between thinking that and also it's rude to ignore someone. so far i'm not v happy about it all. and when our computer crashed but I had ebay listings I went to the library first thing on the mondya to tell people I couldn't sennd their items (was ebooks) and gave a full refund.

have you filed a dispute?

munz · 09/05/2007 11:54

no is that the next stage? I feel I should wait longer as it was a bank holiday but also how long should I wait realistically?

OP posts:
sixlostmonkeys · 09/05/2007 12:00

A buyer may initiate an Item Not Received dispute anytime between 10-60 days after the listing closes.

If she is ignoring your messages I feel you have no alternative. bank holidays don't prevent you from answering messages (and if she went on hols then she shouldn't have left her sales up in the air - It's not your problem)

A dispute usually jogs them into action. usually they respond, send your item and then you can close the dispute

munz · 09/05/2007 12:02

right will initiate now and see what happens form here - theres no mention of her having a holiday etc.

i'm not totally heartless and realise that children etc might have ment seller can't make the PO, but surly should be able to make an email?

OP posts:
munz · 09/05/2007 12:04

now worried she'd got nothine else listed at the minute one FB says recieved today (as in today) from the 22nd april.

OP posts:
sixlostmonkeys · 09/05/2007 12:12

She is obviously very slow at posting the stuff.

It's ok (and shows what a lovely person you are) to consider all the possible reasons, but at the end of the day you need to get things moving and then if worst comes to the worst you can claim your money back.

I'm sure if she would just respond to your emails with an apology, telling you that she has broke her leg or something, you would be fine about the whole thing, but the fact remains she is ignoring you. Hopefully the dispute notice will wake her up.

munz · 09/05/2007 12:17

thanks, I don't want to seem unreasonable. am sure it's perfectly fine, it's jsut when you pay £3 odd for 1st class you expect first class. how will the/any refunds work when paying by cheque? - it's not a great deal, (£10)so if needed will be put to exp but tbh i'd rather have my goods.

also happened to me, wedding dress not arrived yet, same timing as yours pretty much.
I have received one email saying on its way, but having health probs which I understand. I however need the dress to get married in!
More emails, no response.
If you petition ebay and open up a dispute, it does not automatically give her a black mark, it lets her know you are serious and gives her further opportunity to respond/deliver item/refund item, but more formally.
Once it is opened, the ball is rolling so you can take it further if you still dont get any luck.
I paid with paypal and therefore my dispute goes through them, they have opened a resolution centre where I petition the seller formally, via them and then I can put in a claim after 20 days. I am sure ebay do this themselves for other payment methods.

sixlostmonkeys · 09/05/2007 12:20

tbh I'm not sure how the refund works with cheques. With paypal it's pretty straight forward.
Hopefully someone else can come along and tell you more.

sixlostmonkeys · 09/05/2007 12:22

Oh wedding dress!!
That reminds me I really should get mine on ebay.

Brand New with tags wedding dress anyone?

munz · 09/05/2007 12:23

I've still got mine, don't have the heart to sell it on.

it's awful they've not sent it to you. and yes something you deffo need

(I;'ve done a dispute with paypal - seller ignored those emails as well, paypal refunded me after finding I was right)

ceolas · 09/05/2007 12:31

I would send another email saying you've contacted her x number of times but had no response. You understand how life gets in the way, if there is some problem can she let you know. If you get no response from her by the end of the week ie Friday you will be forced to file a dispute.

FeelingOldnGrey · 09/05/2007 12:32

slm - me! Seeing as mine has not arrived!! Size? Style? Why did you not wear it? (do you mind me asking that?)

PavlovtheCat · 09/05/2007 12:33

slm - that last post was me! I forgot to change my name back oops!

sixlostmonkeys · 09/05/2007 12:42

It's a size 12.
I don't think i could describe it well enough - I know very little about wedding dress descriptions - i know it's not a merangue(sp?) tho
The body (bodice?) is very very pretty and the skirt part is plain but hangs lovely.
I can take a load of photos if you like.

I tried it on once. My friend burst into tears because she said i looked so beautiful...aww (first and last time that's ever been said about me)

I was going to get married in Vegas, had everything booked and paid for etc. then the relationship fell apart and that was the end of that.

the wedding dress has been at my aunt's ever since. She is one of those spotless meticulous organised people and I reckoned the dress would be safer there than here where a little boy may decide to ' turn that dress into a tent'

PavlovtheCat · 09/05/2007 12:49

slm - could you take some pictures? If I have to continue the dispute I have, I will need another wedding dress. And I dont want a merangue either!
Do you know bust/waist size?
I would be interested in taking a look?
Sorry to hijack your thread Munz!

sixlostmonkeys · 09/05/2007 12:53

I will take a load of photos for you. Ill measure it all and also take note of seam allowance etc.

munz · 12/05/2007 14:54

ok, have done a dispute with ebay and now also sent another email on fri asking when it would be sent - so far i've had absolutly nothing nothing to ebay nothing to me. i'm really pissed off now. should I escalate to a claim or wait yet longer still?

OP posts:
munz · 14/05/2007 11:32

still nothing no emails no items - should I leave a negative yet? I don't want to without a responce, but I feel i've been fair enough?

OP posts:
sixlostmonkeys · 14/05/2007 11:39

Have you escalated to a claim? if you haven't then I'd do it now.

Once its sorted then think about the Feedback.
If she doesn't respond to the dispute she will be unable to leave feedback (I think)

munz · 14/05/2007 11:40

not escalated yet - I think I need to wait for 10 days don't i? - i'm not very good thou at talking to people on the phone if I don't know them to ask for things iycwim.

OP posts:
pigsinmud · 15/05/2007 11:56

I put in a claim with ebay about 7 weeks ago. Once you've escalated to a claim they 'll email you a form to fill in. You have to have proof of the payment from your bank account and send them international bank numbers etc.. The form has to be received by them (somewhere in Germany) within 2 weeks of them sending the email form to you, otherwise they throw the claim out.

I have heard nothing about my claim - I paid by bank transfer and never got my ipod. The seller suddenly unregistered themselves from ebay a couple of days after I'd won the item. Weird thing was they kept emailing me saying they were just about to post it etc.. I was unlucky as they had sold 1600 items in a year and had 99.9% + feedback.
Good Luck with it.

munz · 15/05/2007 12:03

thanks, I can't escalate until i've had the claim for 10 days - I ahve a feeling thou that they only refund you if the value is over £15 or something - which mine isn't.

I don't care what the reason is at the minute - just a reply would be nice.
