Item not received yet seller has proof I did

Bought a coat on eBay a fortnight ago , hadn't received the item by this weekend so opened a case .
Seller at first agreed to a partial refund but is now saying she has proof that the item has been received as she said she has spoke to the post office and they can confirm they delivered it to my house Confused

I've checked the back garden in case it was thrown over & have asked the neighbours but no sign of it .
Item was not sent recorded just plain 2nd class .

I'm not sure what to do , I have asked to see the proof but she is demanding I close the case Confused

Don't close the case. If you haven't received it then leave it open. Reply to her that you have checked the garden etc and it is not with you.

Therefore she must register a claim with Royal Mail and refund you immediately.

If you haven't already done so escalate the case

What if she leaves horrid feedback ?

Also she is saying it was sent via Royal mail Drop Box , what's that ?

If it's not recorded, the post office can't prove it. The seller is trying their luck. I'd keep the case open. The onus is on the seller to prove the loss in order to get a refund from the post office and I've been there so know it's a pain.

Don't worry about a one off negative, I don't pay too much attention unless it's less than 90% and a seller can't leave neg for a buyer.

She can't leave you feedback as the sale won't have happened when you get your money back

My understanding is that the problem is still the seller's. You haven't received your item so they will have to claim from Royal Mail. Posting can be proved but not delivery unless recorded.

sellers can't neg buyers - they haven't been able to for a long time - and without tracking she will not win the case. Just escalate in 8 days and do neg her stating item not received. She is probably lying hoping you will close the case - you must not close it.

She has messaged back saying she gave me a chance & has now passed it on to eBay to sort out Confused

As long as you've opened a case you just wait to escalate it.

You will get your money back.

I just had someone do that to me - told her politely to refund me and then claim it back from the Royal Mail.

EBay will just refund you if she doesn't

Seller can't do anything in retaliation. It's her fault not yours, and eBay will find in your favour.

She is definitely coming across as a bully. I wouldn't normally bother but it cost me £19 without the postage .

of course you should bother - the value is irrelevant. If an item doesn't arrive then the seller has to refund in full. I am astounded she thought a partial refund was ok. And she is clearly lying saying she has proof of delivery. And now saying she has reported you too. Well please do neg her to warn other buyers.

Just playing Devil's Advocate.......

Thanks to Ebay's policy of the buyer can do no wrong, Sellers on Ebay are having a lot of issues with people claiming that items are not being received when they probably are. There are ways of checking a buyer's history and some times this flags up some very "unlucky" buyer's who seem to have loads of "undelivered" items.

This only seems to happen to EBay parcels - I sell on a number of sites, all my parcels look identical, and yet it is only Ebay parcels that go missing.

I am not saying that this is the case for you MyPanda, but if your seller has been badly scammed this way in the past, she may be just far more cautious than is needed.

The good news is that Royal Mail are now monitoring those addresses that seem to attract a lot of Ebay lost parcel claims.

On top of this, each case opened against a seller counts as a defect. It only takes a few defects and the seller will be penalised heavily. The defects cannot be removed even when it is blatantly apparent that the seller has done nothing wrong.

Is she a seasoned seller or a fairly new one?

I think, as a buyer, I would approach her in a more understanding way - you may still not get anywhere but it is worth a try.

I have been nothing but reasonable , I agreed to a partial refund so neither of us lost out entirely & I have been extremely polite .

I have only had one other parcel not arrive .

If the seller wanted to be more cautious she should have used tracked/signed for.

As I read the thread, the seller is a liar and a bully. There's no way I'd try to be understanding of these traits.

OP, keep the case open, escalate it, get your money back, and help the seller to a nice piece of karma.

I've had 2 not arrive this month. And I don't believe either of them posted the item Hmm

Both items went for a real song and would have been a bargain for me

Pissed off to think it would count against me, the buyer when I've bought hundreds of things that have been delivered no problem

Check the sorting office. I had a similar problem, I was the seller. I had sent the item recorded delivery and according to the website there was a copy of the signature the post man had obtained from the buyer. A week later the buyer emailed me to ask where her item was. I sent her the copy of the signature saying I had presumed she had recieved it. After a couple of days the buyer found it at her local sorting office. It had never been delivered and the post man had signed for it but brought it back to the office.

I have spoke to the sorting office but they have no parcels their for me .
I am now been ignored so just waiting to be able to escalate as I asked to see her proof & since then I've had nothing but silence .

Sorry, I've not really worded it right.

I know stuff does go missing, but we have had a number of claims against us that are clearly from thieves. If all my post goes in the same packaging and posted in the same manner at the same time, why have I had 5 reports in the last 2 months of lost parcels from my Ebay business and none from any other marketplace? BTW I do more business on the others than I do on Ebay so statistically, I should have had more from them.

I am not saying this is the case this time, but Ebay community boards are filled with complaints about people claiming INR where it is strongly suspected that the buyers are lying.

For £19 I would have sent it signed for, but how many of you have received Recorded Mail where the postman hasn't asked for a signature?

How do you know she didn't send it signed for? I have had people claim not to have received something and during the email exchange point out to me that I sent it via a certain method - when I haven't told them how I sent it - so how did they know what method I used?
